Grieving Husband files Talcum Powder Cancer Lawsuit
April 22nd, 2016
Last week, a man filed a wrongful death lawsuit against Johnson & Johnson and multiple additional defendants based on claims that talcum powder products made and sold by the defendants caused the wrongful death of his wife.
Soren Threadgill filed his talcum powder cancer lawsuit on April 18 in Los Angeles Superior Court, according to MyNewsLA.com. In addition to Johnson & Johnson, he seeks to hold Imerys Talc America, Rite Aid Corp. and the Gelson’s supermarket chain liable for his wife’s death from ovarian cancer allegedly caused by use of talcum powder products.
According to his lawsuit, Mr. Threadgill’s wife, Eva Maria Threadgill, used Johnson & Johnson Baby Powder and Shower to Shower talc products daily for feminine hygiene purposes over the course of 25 years. Much of the company’s talc is supplied by Imerys Talc America, and Mrs. Threadgill purchased these products at Rite Aid and Gelson’s stores. After being diagnosed with ovarian cancer in 1998, Eva Maria Threadgill died from the disease in December 2012.
Mr. Threadgill and a growing number of plaintiffs in talcum powder wrongful death and ovarian cancer lawsuits claim that Johnson & Johnson knew or should have known that their talc products had been associated with an increased risk of ovarian cancer when used by females, but that they failed to warn of this risk. Additionally, despite this knowledge, J&J purposefully continued to market Shower to Shower and other products specifically for feminine hygiene uses, telling consumers that “Just a sprinkle a day keeps the odor away”, and that they should use it “anytime you want skin to feel soft, fresh, and comfortable.”
Mr. Threadgill also cites multiple studies and instances where J&J was clearly warned of the link between genital use of their talcum powder products and ovarian cancer. According to his lawsuit, the CEO of the company was warned by the Cancer Prevention Coalition in 1994, after studies showed that use of talcum powder in the genital area put women at “a serious risk of ovarian cancer.” He also cites a 2006 warning by the International Association for the Research of Cancer (IARC) that talcum powder was a human carcinogen.
In February, a St. Louis jury awarded $72 million in damages to a family after they were able to prove that a beloved mother died from ovarian cancer caused by use of J&J talcum powder products. In this case, the company was ordered to pay a monumental $62 million in punitive damages because it was so clear to the jury that they were aware of ovarian cancer risks and willfully withheld warnings from the public.
In addition to the lawsuit recently filed by Mr. Threadgill, Johnson & Johnson is reportedly facing more than 1,000 lawsuits based on claims that they failed to warn of deadly talcum powder cancer. If you or a woman you love has been diagnosed with ovarian cancer after using talcum powder for personal hygiene, or if you have suffered the wrongful death of a loved one due to talcum powder ovarian cancer, you may be entitled to substantial compensation.
