Fifth Talcum Powder Lawsuit in St. Louis to Begin Trial Next Week

Next week, the trial for a fifth talcum powder lawsuit will begin before a jury in St. Louis, Missouri.
The trial for the lawsuit filed by Lois Slemp, 61, will begin on April 10 before Judge Rex M. Burlison in the 22nd Circuit Court in St. Louis, Missouri. Due to a loophole in state laws, Missouri is one of the few states that allows out-of-state plaintiffs to tag along with personal injury lawsuits filed by state residents. This location has become especially appealing to many plaintiffs in talcum powder lawsuits because it has a reputation for speedy trials and plaintiff-friendly juries, among other perceived benefits, so a large number of talc plaintiffs from across the United States have chosen to file their complaints there.
In her lawsuit, like the thousands of other plaintiffs in pending talcum powder cancer lawsuits, Lois Slemp alleges that she used talcum powder for genital hygiene purposes because she believed this to be both a healthy and safe practice. However, it has been suggested that Johnson & Johnson, the maker of Johnson’s Baby Powder and Shower-to-Shower, as well as other defendants in talc lawsuits, knew for many decades of research associating perineal application of talc with a substantially increased risk of ovarian cancer and other cancers. Like a growing number of plaintiffs, Ms. Slemp alleges that she never would have used talcum powder products for personal hygiene had J&J and others properly warned of even a potential risk of cancer. Since she was never warned, Ms. Slemp continued to use talcum powder products and was subsequently diagnosed with ovarian cancer.
In December, attorneys for Lois Slemp petitioned for an earlier court date in light of her rapidly deteriorating condition. In a motion filed before the court, attorneys argued that Ms. Slemp’s trial should begin on the date in February for which another talcum powder lawsuit filed by Nora Daniels, had been scheduled. The motion stated, “Chemotherapy has weakened the lining of (Slemp’s) heart and muscle, which resulted in a heart attack several weeks ago. She is not currently fit for a resection of the liver metastasis due to the cardiac problems. She is undergoing additional rounds of chemotherapy in an effort to slow the metastasis.” In light of Ms. Slemp’s terminal condition, attorneys stated, “She is unlikely to see her day in court, whereas Ms. Daniels’ health makes her claim feasible for a future trial setting.”
In response to this request, Johnson & Johnson argued that this move by plaintiffs’ attorneys was merely an attempt to throw the defense off and undermine their selection of the case for the February trial date. They stated, “It is simply not fair to Defendants or to Plaintiff Daniels to discard this system (of selecting trial order) and proceed with the claims of Plaintiff Slemp in February.” Imerys Talc America, another defendant, also opposed the request to move Slemp’s trial up, and plaintiffs’ petition was overruled by Judge Burlison on January 24, 2017.
The trial for the lawsuit filed by Lois Slemp will be the fifth talcum powder cancer lawsuit to go before a St. Louis jury. The first three lawsuits to go to trial in this court ended in massive verdicts in favor of plaintiffs, costing J&J nearly $200 million. The fourth trial, held in February for the lawsuit filed by Nora Daniels, has been the only one to end in a verdict for the defense.
In addition to the claims pending in St. Louis courts, there are also thousands of additional talcum powder cancer lawsuits underway in California, Delaware, and New Jersey, where a multidistrict litigation (MDL) was recently formed and currently centralizes at least 158 separate cases for coordinated pretrial proceedings.
