Man files Talcum Powder Lawsuit after Mother dies from Ovarian Cancer

As media attention to the possible link between genital application of talcum powder and ovarian cancer increases, so do the number of personal injury lawsuits filed against Johnson & Johnson and other talc manufacturers and suppliers. In many of these cases, the plaintiffs are women who believe their ovarian cancer diagnosis is a result of using talcum powder for personal hygiene. In other cases, such as a recent lawsuit filed in Tennessee, the plaintiffs are family members who lost a woman they loved to ovarian cancer.
On September 19, Kristopher George filed a talcum powder cancer lawsuit on behalf of his late mother, Stephanie Marie Kelley, in the U.S. District Court for the Eastern District of Tennessee. According to Mr. George’s complaint, his mother used talcum powder for feminine hygiene purposes on a regular basis for most of her life. Stephanie Michelle Kelley was born in 1969, and she was diagnosed with ovarian cancer her son believes was caused by exposure to talcum powder in March 2015. She lost her battle with ovarian cancer in September 2015.
Like other plaintiffs in talc lawsuits, George alleges that Johnson & Johnson and other manufacturers of talc body powders had been presented with evidence that genital application of talc may significantly increase a woman’s likelihood of developing ovarian cancer decades ago. In fact, since researchers in 1971 identified talc particles in the majority of ovarian cancer tumors they dissected, at least 20 epidemiological studies have drawn a correlation between talcum powder and ovarian cancer.
Despite the fact that Johnson & Johnson was aware of research linking talcum powder with ovarian cancer for at least 40 years, the company not only failed to warn of this possible risk but also specifically promoted their Johnson’s Baby Powder and Shower-to-Shower powder for feminine hygiene purposes. Slogans like, “Just a sprinkle a day helps keeps the odor away” led women to believe that it was safe and beneficial to sprinkle talcum powder on their undergarments, sanitary napkins, and directly on their genital area. Furthermore, some plaintiffs have presented evidence in the form of internal J&J communications in which company officials discuss how to prevent reports of talcum powder ovarian cancer from affecting their profits. Still, the company and other talc product manufacturers continued to opt against warning consumers about this potential risk.
According to Kristopher George, his mother used J&J talcum powder products “to dust her perineum for feminine hygiene purposes. This was an intended and foreseeable use of the products based on the advertising, marketing and labeling of the products.” Due to J&J’s alleged misrepresentation of talcum powder safety and failure to warn of known risks, he demands compensation in the form of $5 million for medical expenses, pain and suffering, funeral costs, loss of his mother’s love, and other damages. He also requests that punitive damages in the amount of $1 million be awarded by a jury to punish J&J for their gross negligence.
Already this year, two plaintiffs have been awarded multi-million dollar verdicts in talcum powder lawsuits, and now so many similar lawsuits have been filed that a petition has been entered to centralize them before a single judge for a more convenient and efficient process.
