Plaintiff Gives Compelling Testimony at Talcum Powder Lawsuit Trial

A plaintiff who once feared she would not live to attend the trial for her talcum powder cancer lawsuit recently gave compelling testimony to a St. Louis jury.
On two occasions, Johnson & Johnson has attempted to delay the trial for the talcum powder ovarian cancer lawsuit filed by Deborah Giannecchini in 2014. Though Giannecchini lives in California, she and other plaintiffs have taken advantage of a unique Missouri law which allows them to file their talcum powder lawsuits there, where 64 claims have been combined in a joint talcum powder lawsuit. According to the Montgomery Advertiser, J&J attempted to have these claims disbanded in 2014 based on claims of a fraudulent misjoinder, but a judge ruled to allow them to proceed.
The second attempt to delay Giannecchini’s day in court came only a week before the trial was set to begin, when J&J asked to delay her trial until a decision was made regarding the formation of a multidistrict litigation (MDL) combining all federal talcum powder lawsuits. This time, Giannecchini’s attorneys filed an emergency motion for the judge to allow the trial to proceed as scheduled in St. Louis, stating that her Stage IV ovarian cancer made it unlikely their client would live to hear a verdict if the trial was postponed again. The motion was granted, and the jury has now spent more than two weeks listening to testimony from witnesses.
According to her complaint, Deborah Giannecchini, now 63, was diagnosed with ovarian cancer four years ago in 2012. She says that she used talcum powder for feminine hygiene from the time she was in high school, which amounts to roughly 44 years of regular use of products including Johnson’s Baby Powder and Shower-to-Shower. Like other plaintiffs, Giannecchini alleges that J&J and other defendants had been aware of mounting scientific evidence linking perineal application of talc to ovarian cancer for decades but they withheld warnings of this risk in an effort to protect their profits. Also like other plaintiffs, Giannecchini alleges that J&J even specifically promoted their products for women to maintain “personal freshness” by applying them to their undergarments, sanitary napkins, and perineal region. She even brought advertising campaigns recommending this use of J&J talcum powder to the forefront of jurors’ minds when she sang softly, “Have you had your sprinkle today?”
Deborah Giannecchini never faltered as she delivered her testimony in a soft, clear voice, but her accounts of her struggles brought tears to jurors’ eyes. A local CBS affiliate reports that when her lawyer asked her about the impact ovarian cancer has had on her life, she said, “Devastating, my life has changed beyond what I can tell you.” She also recounted her suffering through multiple surgical procedures and aggressive cancer treatments, and stated that she has lived the past four years in a constant fear of death.
Giannecchini echoed the sentiments of other plaintiffs in talcum powder lawsuits when she expressed dismay at the fact that neither her doctors nor J&J ever once provided her with warnings of the potential link between talcum powder and cancer. When her attorney asked about her motivation for filing her lawsuit, she said, “Because if there’s even the slightest chance this product has caused this disease, there needs to be a warning.” Upon cross examination, when a J&J attorney asked her, “So the only people who told that are your lawyers,” she simply said, “Yes.”
This trial is the third in a series of bellwether trials designed to help attorneys gauge likely jury responses to evidence and testimony which will be used in additional claims. In the previous two bellwether trials for this joint lawsuit, plaintiffs were awarded multi-million dollar verdicts by jurors who later expressed outrage at the lengths to which J&J and other defendants went to hide talcum powder cancer risks. Though an attorney for these plaintiffs has urged J&J to propose a settlement for the remaining thousands of claims against them, the company has yet to do so. However, if this trial ends the way the first two did, J&J could be facing significant financial losses and may benefit from settling more claims before they go before juries, which have been historically sympathetic to plaintiffs.
