Plaintiff Claims Mother’s Fatal Fallopian Tube Cancer Caused by Talcum Powder

While the vast majority of the recently filed talcum powder cancer lawsuits are based on allegations that plaintiffs or their loved ones were diagnosed with ovarian cancer after using products like Johnson’s Baby Powder, it has been suggested that other gynecological cancers may result from genital application of talc. In one such lawsuit, a woman claims that her mother died from fallopian tube cancer after using talcum powder products for personal hygiene.
Amie Cavazos filed her talcum powder wrongful death lawsuit on March 17 in the U.S. District Court for the District of Columbia. According to this complaint, the plaintiff’s mother, Rosalinda Cavazos, died from cancer of the fallopian tubes after using talcum powder products for more than thirty years. Cavazos alleges that defendants Johnson & Johnson, Imerys Talc America, and the Personal Care Products Council knew of the potential link between gynecologic cancers and perineal application of talc but intentionally withheld warnings of this risk.
Though research has been linking the use of talcum powder for feminine hygiene with a possible increase in the risk of cancer for decades, it was only recently that most consumers learned of this. The recent increase in knowledge of potential talc cancer links is due in part to a number of multi-million dollar settlements awarded to plaintiffs in talcum powder cancer lawsuits. In these very public lawsuits, plaintiffs’ attorneys presented evidence of corporate collusion to hide the research linking talc use to cancer from regulators and consumers so that companies like J&J would not suffer diminished profits. Of the four talcum powder cancer lawsuits that have gone before a jury in St. Louis so far, three have resulted in verdicts for plaintiffs.
Since as early as 1971, scientific research has suggested that women who use talcum powder products like Johnson’s Baby Powder and Shower-to-Shower to reduce feminine odor and moisture may face a significantly higher risk of developing cancer of the reproductive organs. Though most of this research focuses on the risk of talcum powder ovarian cancer, some studies and a number of plaintiffs have argued that talc may also increase the risk of other gynecologic cancers. Fallopian tube cancer, according to the American Cancer Society, “is similar to epithelial ovarian cancer,” and some doctors believe that cancer of the fallopian tubes may actually lead to ovarian cancer.
According to the recent lawsuit filed by Amie Cavazos, her mother, Rosalinda, used talcum powder products for feminine hygiene purposes from at least 1978 until 2011. Rosalinda Cavazos was diagnosed with cancer of the fallopian tubes in August 2013, and she died in March 2015.
Like millions of other women, Rosalinda Cavazos was led to believe by allegedly aggressive marketing that this use of talc was not only safe but also hygienic. Since the earliest studies linking talc to cancer in women were published years before she began to use these products for personal hygiene, her daughter claims that the makers of talc products misled her and others about their safety.
Amie Cavazos claims in her lawsuit, “The Defendants failed to inform its customers and end users of the PRODUCTS of a known catastrophic health hazard associated with the use of its products. In addition, the Defendants procured and disseminated false, misleading, and biased information regarding the safety of the PRODUCTS to the public and used influence over governmental and regulatory bodies regarding talc.”
At this time, all talcum powder cancer lawsuits filed in federal courts have been centralized before U.S. District Judge Freda Wolfson in the District of New Jersey for coordinated pretrial proceedings as a multidistrict litigation.
