Family files Ovarian Cancer Wrongful Death lawsuit against Johnson & Johnson, Imerys Talc America

In Pennsylvania, another family has filed a wrongful death lawsuit against Johnson & Johnsons and their supplier, Imerys Talc America, after losing a woman they loved to ovarian cancer they believe was caused by genital use of talcum power.
On June 7, Nancy Bors filed a talcum powder cancer lawsuit in the U.S. District Court for the Eastern District of Pennsylvania. The lawsuit was filed on behalf of the estate of her late mother, Maureen Broderick Milliken, who died from ovarian cancer in 2014. According to this claim, Maureen Milliken developed ovarian cancer as a result of “regular and prolonged” use of Johnson & Johnson talcum powder products including Johnson’s Baby Powder in the genital area for most of her life. Milliken was only 58 years old when she died.
Bors may have been prompted to file this lawsuit after learning of two recent multi-million dollar verdicts in ovarian cancer lawsuits against J&J and Imerys and the considerable media attention on these lawsuits and the fact that scientists identified a possibly significant risk between talcum powder and ovarian cancer many decades ago. Some of the more than 1,000 plaintiffs in recently filed talcum powder cancer lawsuits have said that they were encouraged by generations of women in their families as well as advertisements directly marketing talc for feminine hygiene purposes to believe “baby powder” was safe, sanitary, and healthy to sprinkle on undergarments, sanitary napkins, and directly on their genital regions. According to these plaintiffs, it was only when news of recent verdicts began to surface that they learned of the potential risk of talc ovarian cancer.
What is especially infuriating to Bors and other plaintiffs in talcum powder lawsuits is the recently-gained knowledge that even in the 1970s scientists were warning J&J and other talcum powder makers that talc was being found in a substantial percentage (75%) of ovarian cancer tumors. Then, in 1982, the journal Cancer published a study where researchers concluded that “women who dusted their genitals and sanitary napkins with talcum powder were three times as likely to develop cancer as women who did not.” This study was also noted in an article in the New York Times. In 2006, the International Agency on Cancer Research (IARC), deemed talcum powder “possibly carcinogenic to humans.” Importantly, 2006 is also the year that Imerys, J&J’s only supplier of talc, began to warn of the possible risk of talcum powder ovarian cancer.
Still, though, J&J chose not to extend this warning to their millions of consumers who they knew to be using talcum powder for genital hygiene—partially, some believe, because of direct marketing by J&J promoting this potentially dangerous use.
In her lawsuit, Bors echoes other plaintiffs when she claims that Johnson & Johnson willfully exposed millions of women to the known risk of talcum powder ovarian cancer. She claims, “During the time in question, the Johnson & Johnson Defendants advertised and marketed this product as a beacon of ‘freshness’ and ‘comfort’, eliminating friction on the skin, absorbing ‘excess wetness’ helping keep skin feeling dry and comfortable, and ‘clinically proven gentle and mild’. The Johnson & Johnson Defendants compelled women through advertisements to dust themselves with this product to mask odors.”
Even as the talcum powder cancer lawsuits against Johnson & Johnson continue to be filed, the company has stated that they do not believe their product is unsafe in any way and do not believe it may cause cancer.
