J&J Talcum Powder Ovarian Cancer Death Lawsuit goes before Jury in St. Louis

The trial for a wrongful death lawsuit in which a family alleges that a woman died of ovarian cancer caused by Johnson & Johnson talcum powder began earlier this week.
Jackie Fox died of ovarian cancer last year at the age of 62 after her family says she “suffered horribly” through multiple rounds of chemotherapy and painful treatments, according to Bloomberg. Her family believes that her life-long, daily use of Johnson’s Baby Powder and other talcum powder products contributed to her development of cancer. They claim that the makers of this baby powder product, Johnson & Johnson, knew for decades that their talc products may cause ovarian cancer when used for feminine hygiene purposes but took steps to hide this risk from consumers in order to protect their own profits.
An attorney for the family of Jackie Fox told jurors in his opening remarks on Tuesday that internal documents from J&J show that the company was well aware of multiple studies linking talcum powder and ovarian cancer. He stated, “The evidence—the internal documents—will show that the company valued profits over human life.” In fact, the judge who denied a request from J&J to dismiss the lawsuit said that there was “ample evidence” that may show a jury that company executives conspired to hide the documented link between talcum powder and ovarian cancer.
In their attempt to have the lawsuit dismissed, J&J attorneys cited a statement made by the FDA in April 2014 that they could not find “conclusive evidence” of an increased risk of ovarian cancer after regular use of talc products for feminine hygiene purposes. In addition to noting the evidence of the company’s attempt to hide this risk from consumers, the judge also reminded J&J that their talcum powder product in question is labeled as cosmetic, which gives the FDA “a limited scope of regulatory authority” over the baby powder.
To win this case before a jury which consists of nine women and three men, attorneys for Jackie Fox’s family must only prove that use of J&J talcum powder contributed to her cancer diagnosis-not that it was the sole cause of her cancer. The family does not deny that Fox had other precursors to ovarian cancer including blocked fallopian tubes, but they still claim that her use of baby powder over the course of her lifetime greatly increased the likelihood that she would develop cancer.
Since the early 1970s, multiple scientific studies have suggested that regular use of talcum powder may greatly increase a woman’s chance of developing ovarian cancer and it appears that J&J’s attempt to hide this link goes back nearly as far. In 1971, a study from researchers in the United Kingdom identified traces of talc in 75% of the ovarian cancer tumors they tested. When a study published in the journal Cancer in 1982 said that women who use talc for feminine hygiene purposes are three times more likely to develop ovarian cancer, officials from Johnson & Johnson told the New York Times that their “cosmetic-grade talc” certainly did not cause cancer. Harvard professor Daniel Cramer found in 1982 and again in December 2015 that use of talcum powder may significantly increase the risk of ovarian cancer, and that the risk is even higher the longer talc is used by women.
According to the attorney for Ms. Fox’ family, “J&J was aware of every one of these studies going back 30 to 40 years”, and he even says that the company created a task force as a “defense strategy” to protect them from ovarian cancer lawsuits in the 1990s.
In a deposition shortly before her death, Jackie Fox said she was “raised on” Johnson’s Baby Powder and that she used that or related talcum powder products every after showering until she was diagnosed with cancer. Her family’s lawsuit is one of roughly 1,000 talcum powder ovarian cancer lawsuits the company is facing right now. Representatives of the company continue to claim that evidence will support their assertions that there is no risk of ovarian cancer associated with “cosmetic-grade” talc.
