Talcum Powder Lawsuit Claims J&J Should Have Replaced Talc With Cornstarch

In a recent talcum powder lawsuit, a woman claims that her suffering and the suffering of an unknown number of additional women could have been avoided if Johnson & Johnson had simply replaced the talc in their body powder products with cornstarch, which is not associated with an increased risk of ovarian cancer.
On November 1, 2016, Mary Young filed her talcum powder ovarian cancer lawsuit against Johnson & Johnson and other defendants in the U.S. District Court for the Southern District of Georgia. Here, she alleges that J&J had been warned that perineal application of talcum powder may increase the risk of ovarian cancer, and failed to warn consumers of this risk. She goes on to allege that J&J had also been urged to replace the talc in their products with cornstarch to eliminate this risk, but that they elected not to do so. As a result of this negligence, Young alleges that she was diagnosed with ovarian cancer after using J&J products like Johnson’s Baby Powder and Shower-to-Shower for feminine hygiene purposes.
Young is not alone in filing such claims against Johnson & Johnson. In fact, the company is currently facing more than 1,000 talcum powder lawsuits in the United States brought by plaintiffs who seek to hold them accountable for intentionally withholding warnings about possible talc cancer risks. The number of talcum powder lawsuits has significantly increased in the past year, as a result of a number of multi-million dollar verdicts in favor of plaintiffs which have amounted to combined awards of nearly $200 million. While most of these damages will be paid by J&J, other defendants such as their talc supplier Imerys Talc America have also incurred major losses.
In talcum powder lawsuits, plaintiffs make similar claims that J&J had access to decades’ worth of scientific evidence in the form of more than 25 studies published since 1971 that use of talcum powder for feminine hygiene may significantly increase a woman’s risk of ovarian cancer and chose not to warn consumers of this risk. In some product liability lawsuits, it is necessary for plaintiffs to claim that a defendant “should have known” of a product’s risks and failed to warn of them, but this is not necessary for talcum powder cancer plaintiffs. Here, plaintiffs can state that J&J absolutely knew of the possible risk of talc cancer—since attorneys have gained access to internal J&J memos detailing company officials’ discussions of how to keep studies linking talc to cancer from affecting their profits. The Montgomery Advertiser reports that in 1997, a consultant paid by J&J even warned executives, “Anybody who denies this risks that the talc industry will be perceived by the public like it perceives the cigarette industry: denying the obvious in the face of all evidence to the contrary.”
In addition to their failure to warn of potential talcum powder cancer risks, Young and other plaintiffs also state that J&J was encouraged years ago to replace talc in their body powders with cornstarch to eliminate any cancer risks. On November 19, 1994, the Cancer Prevention Coalition issued a letter directly to the then-CEO of Johnson & Johnson, Ralph Larsen. Here, Larsen was expressly warned that talcum powder may be associated with ovarian cancer. In light of this potential risk, the CPC urged Larsen to “substitute cornstarch, a safe organic carbohydrate, for talcum powder products, and also to label its products with a warning on cancer risks.” This statement was taken from a press release on the website of the Organic Consumers Association announcing a 2008 petition to the FDA to add cancer warnings to all cosmetic talc products. The Commissioner of the FDA at the time, Andrew von Eschenbach, M.D., did not respond to this petition. A previous petition which had been submitted in November 1994 was denied.
According to her lawsuit, Young did not begin to use talcum powder for feminine hygiene until approximately 1995—a year after J&J was urged to replace talc in their products with cornstarch and to warn of talc cancer risks. She says that she applied talcum powder to her perineum until 2015, when she was diagnosed with ovarian cancer. She claims that her diagnosis is a direct result of J&J’s willful negligence, stating, “At all pertinent times, a feasible alternative to [Johnson & Johnson’s talc powder products] has existed. Cornstarch is an organic carbohydrate that is quickly broken down by the body with no known health effects. Cornstarch powders have been sold and marketed for the same uses with nearly the same effectiveness.”
This recent talcum powder lawsuit was filed in a federal court, so it will join the talc cancer multidistrict litigation (MDL) centralizing related claims before a single judge for coordinated pretrial proceedings in New Jersey.
