Why Are So Many Talcum Powder Lawsuits Pending in St. Louis?

Recently, all talcum powder cancer lawsuits filed in federal courts were centralized for coordinated pretrial proceedings as a multidistrict litigation (MDL) before a U.S. District Judge in New Jersey. In addition to these claims, there are also multiple talcum powder lawsuits which were filed at the state level, and a substantial number of these claims are pending in St. Louis, Missouri. Although all of the St. Louis lawsuits were filed in Missouri, not every plaintiff in these claims is a resident of that state. So how is it possible for non-residents to file claims in Missouri, and why have so many talcum powder cancer lawsuits been filed there?
According to a recent article in Bloomberg, there is a unique “quirk” in Missouri law which allows plaintiffs from out of state to combine their lawsuits with related claims, as long as one of those claims was filed by a Missouri resident and another was filed by a resident of the defendant’s state. In the case of the talcum powder lawsuits pending in St. Louis, the defendant, Johnson & Johnson, is headquartered in New Jersey. Of the 65 talcum powder cancer lawsuits currently pending in St. Louis, only one was filed by a Missouri resident.
While this explains how it was possible for so many out-of-state plaintiffs to file talcum powder lawsuits in Missouri, it does not explain why this may be beneficial to plaintiffs. Apparently, of the two circuit courts in St. Louis, the court located in the city proper is a sought-after destination for product liability claims filed against large corporations. One reason for this is the size of the court itself, which features 13 courtrooms and 18 general trial judges and is able to handle more than 300 cases every year. This allows cases to be heard more quickly than they would in smaller courts.
In addition to the size of the St. Louis city court, there are additional benefits to filing a product liability lawsuit here. St. Louis has a reputation for a fairly liberal citizenry, and it is believed that this makes jurors from the area more apt to sympathize with plaintiffs than the large corporations they sue. Furthermore, a plaintiff only needs to convince 9 of the 12 jurors in a Missouri state court of the validity of their claims in order to win at trial, while the verdict in a federal court must be unanimous. In addition to a more liberal jury pool, St. Louis also has more liberal rules for the submission of evidence—which means that some expert witnesses may be allowed in a St. Louis court when they may be dismissed elsewhere. According to Bloomberg, over the past three years [St. Louis city court] has developed a reputation for fast trials, favorable rulings, and big awards.”
While St. Louis is something of a personal injury hot spot right now, there are some limitations plaintiffs face there. For example, any joint lawsuit which combines more than 99 claims must be turned over to federal courts. Additionally, University of Richmond law professor Carl Tobias says that state legislatures typically try to rein in courts which develop a reputation for being “plaintiff-friendly,” and predicts that future Missouri legislation will seek to limit the rights of out-of-state plaintiffs. If this happens, eventually another jurisdiction will become the next venue of choice for these types of lawsuits.
Bloomberg says, “So far this year, three of the top six product defect verdicts in the U.S., totaling $173.5 million, have come out of the St. Louis court. Two of those were against J&J over an alleged link between talc and ovarian cancer.” The third talcum powder cancer lawsuit in this joint litigation was filed by a California woman named Deborah Giannecchini, and it was recently reported that members of her St. Louis jury were moved to tears by her compelling testimony about the way her ovarian cancer diagnosis has impacted her life. In light of this jury response, some are predicting that yet another multi-million talcum powder cancer award is on the horizon.
