Woman files Talcum Powder Lawsuit after 10 Year Battle with Uterine Cancer

While the vast majority of the talcum powder lawsuits filed against Johnson & Johnson have been based on claims that the company’s talc body powders caused ovarian cancer, recently a number of plaintiffs have sued the company for damages resulting from uterine cancer. Last week, a California woman filed such a suit against J&J, claiming that the company is responsible for her decade-long battle with uterine cancer because they failed to warn of known cancer risk associated with their talcum powder products.
Dolores Gould filed her talcum powder uterine cancer lawsuit on July 8 in the U.S. District Court for the Northern District of California, charging Johnson & Johnson with strict liability, failure to warn, and other counts related to her diagnosis with uterine cancer. Gould alleges that her 2006 diagnosis with uterine cancer is a direct result of her lifetime use of Johnson’s Baby Powder and Shower-to-Shower, both talc-based products made by J&J and historically used for the reduction of feminine odors.
In her lawsuit, Gould claims that her mother used Johnson’s Baby Powder on her during diaper changes and for other hygiene purposes since she was born in 1975. Like her mother and other relatives and women before her, Gould then went on to use J&J talc-based powder products on and around her genitals to control odor. Like other plaintiffs in talcum powder lawsuits, she claims that J&J knew for decades that genital application of talcum powder could significantly increase a woman’s risk of developing ovarian or uterine cancer, but that the company willfully and negligently failed to warn of this risk. She also claims that, despite knowledge of this risk, J&J continued to market Shower-to-Shower and other talc products specifically for the reduction of feminine odor.
According to Gould’s lawsuit claim, “Defendants’ products failed to contain, and continue to this day not to contain, adequate warnings and/or instructions regarding the increased risk of cancer, including, but not limited to, ovarian and uterine cancer, with the use of their products by women. Defendants continue to market, advertise, and expressly represent to the general public that it is safe for women to use their product regardless of application.”
Dolores Gould is not the first plaintiff to sue J&J on claims that their talcum powder products caused cancer. In fact, the company is currently facing more than 1,000 similar lawsuits. However, most of these lawsuits allege that use of J&J talc products caused ovarian cancer, not the uterine cancer claimed by Gould. Still, Gould and a handful of other plaintiffs claim that the mechanism by which talcum powder may enter the vagina to cause ovarian cancer may also cause uterine cancer. Additionally, though most of the research linking talc to gynecologic cancer is focused on ovarian cancer, in a recent lawsuit one man who lost his wife to possible talcum powder uterine cancer cited research from 1976 which “found a statistically significant 21% increased risk of endometrial (uterine) cancer in postmenopausal women who had ever applied talcum powder in the perineal area. This risk rose to 24% for postmenopausal women who applied talc in the perineal area “regularly,” defined as at least once a week.”
In other lawsuits, including two recent talcum powder lawsuits which resulted in multi-million dollar verdicts against Johnson & Johnson, plaintiffs have referred to dozens of epidemiological studies linking genital application of talc products to gynecologic cancer. They have also presented internal company memos in which J&J officials discuss these studies at the same time as they discuss ramping up marketing efforts to women who already have a history of using talcum powder for feminine hygiene. Essentially, not only did J&J willfully fail to warn of the risk of talcum powder cancer, but they also allegedly continued to promote their talc products for the uses specifically believed to cause the cancer in spite of this known risk.
Dolores Gould has asked for a jury trial and demands at least $75,000 in compensation for her medical and legal expenses, pain and suffering, and other damages as well as punitive damages against Johnson & Johnson. While punitive damages are not often awarded in personal injury lawsuits, juries have already awarded substantial punitive damages in two talcum powder lawsuits this year.
