Woman claims Talcum Powder caused Ovarian Cancer Diagnosis at 24 Years Old

Media coverage of recent multi-million dollar verdicts in lawsuits in which plaintiffs allege that use of talcum powder led to a diagnosis with ovarian cancer has thrust this issue into the spotlight and led to a dramatic increase in talcum powder lawsuits filed against Johnson & Johnson, their suppliers, and other makers of talc-based body powder products. In most of these lawsuits, the plaintiffs were diagnosed with ovarian cancer at an age where they were past their childbearing years, but in one recent talcum powder lawsuit the plaintiff claims that use of talcum powder caused her to be diagnosed with ovarian cancer at just 24 years of age.
Dolorae Handy states in a talcum powder ovarian cancer lawsuit filed on August 24 in the U.S. District Court for the Eastern District of Pennsylvania that she was diagnosed with ovarian cancer in 2005, when she was only 24 years old. Here, she claims that defendants, including Johnson & Johnson, Imerys Talc America, and others, knew that genital application of talc may increase the risk of ovarian and gynecologic cancers yet willfully neglected to warn of this risk.
In her lawsuit, Handy states, “The defendants had a duty to know and warn about the hazards associated with the use of J&J Talc Products. The Defendants failed to inform customers and end users of Johnson & Johnson’s Baby Powder and Johnson & Johnson’s Shower-to-Shower of known catastrophic hazard associated with the use of its products.” In order to show that J&J and other defendants knew or should have known that application of talcum powder to sanitary napkins, undergarments, or directly to the genital area may increase the risk of ovarian cancer, Handy cites multiple scientific research studies dating back to 1971 in which a correlation between talcum powder and ovarian cancer is suggested.
Handy also cites specific warnings given directly to J&J regarding this risk, including a letter sent by the Cancer Prevention Coalition in 1994 that states that research from as far back as the 1960s “…show[ ] conclusively that frequent use of talcum powder in the genital area pose a serious health risk of ovarian cancer.” She states that, at this time, J&J and other talc product manufacturers were encouraged to change to cornstarch-based body powders to eliminate the risk of ovarian cancer, but they chose not to do so.
Because of her young age at the time of her diagnosis, Handy faces especially long-term consequences and damages. According to the American Cancer Society, “Ovarian cancer is rare in women younger than 40. Most ovarian cancers develop after menopause. Half of all ovarian cancers are found in women 63 years of age or older.” As a young woman diagnosed with ovarian cancer, it is possible that Ms. Handy’s future ability to bear children will be compromised or that she will be rendered infertile. Additionally, she must cope with the fear that her cancer will recur: the Ovarian Cancer National Alliance reports that roughly 70% of women diagnosed with ovarian cancer will have a recurrence.
According to Handy’s complaint, her diagnosis with ovarian cancer could have been prevented had she been warned about the possible association between genital application of talcum powder and the disease. As a result of the defendants’ alleged failure to warn of this risk, she seeks compensation for her medical expenses, pain and suffering, fear of cancer, loss of enjoyment of life, and other damages and also seeks punitive damages.
