Another Massive Plaintiff Win: Woman Awarded $70 M in Talcum Powder Lawsuit

Yesterday, a St. Louis jury deliberated for only three hours before awarding Deborah Giannecchini $70 million in her talcum powder ovarian cancer lawsuit against Johnson & Johnson and other defendants.
According to Bloomberg, the vast majority of this award–$65 million–is designated as punitive damages specifically designed to punish J&J for their perceived negligence in hiding alleged talcum powder cancer risks from consumers like Giannecchini for decades. The company must also pay 90% of $2.5 million to Giannecchini to compensate her for pain and suffering and medical expenses. She will also receive $2.5 million in punitive damages from Imerys Talc America, the company that has long supplied J&J with the talc used to make their Johnson’s Baby Powder and Shower-to-Shower body powder products.
Deborah Giannecchini, now 62, filed her talcum powder lawsuit in 2014 after being diagnosed with ovarian cancer in 2012. Giannecchini is a resident of Modesto, California, but was able to take advantage of a Missouri law allowing plaintiffs from other states to file joint lawsuits if at least one plaintiff is a Missouri resident. The St. Louis court at which her trial was held has become something of a litigation hot spot in recent years, because it has a reputation for speedy trials and liberal jurors who tend to favor plaintiffs. Of the 54 talcum powder lawsuits joined in this court, Giannecchini’s was the third to go to trial. The previous two trials also resulted in verdicts for the plaintiffs and a total of $127 million awarded in punitive and compensatory damages.
Though St. Louis jurors may have a reputation for being plaintiff-friendly, many believe that it was Giannecchini’s moving testimony and the damning evidence presented by her attorneys that led to this verdict. According to reports, Giannecchini spoke in a clear, soft voice as she told jurors last week about the nearly unbearable suffering caused by her years of cancer treatments and constant fear of impending death, bringing tears to the eyes of more than one juror. In addition to this, her attorneys were able to present evidence against J&J so strong that it quickly convinced jurors of their negligence.
The Montgomery Advertiser recently reported that Giannecchini’s attorneys, who also represented the plaintiffs in the two previous talc trials in St. Louis, revealed to the jury internal J&J documents in which company officials discuss the mounting scientific research pointing to talcum powder cancer risks and how to prevent this research from reducing their profits. Not only was the idea of adding ovarian cancer warnings to talcum powder products suggested and dismissed, but there were also discussions about the promotion of talc products to consumers who may be less aware of recent medical research, including ethnic minorities. At one point, a consultant even warned J&J that their continued denial of talc cancer risks would soon become farcical, stating in 1997, “Anybody who denies this risks that the talc industry will be perceived by the public like it perceives the cigarette industry: denying the obvious in the face of all evidence to the contrary.”
According to a lawyer for Giannecchini, this evidence showed the jury that J&J was clearly aware of “30 years of studies showing an increased risk of ovarian cancer from the use of talc.” He told jurors, “They knew, and they knew the public was unaware of the risk.” Rather than warn the public, however, he said J&J “developed a defense strategy to prevent government regulation of its products” and prevent reductions in talc sales. These statements clearly impacted the jury. One juror, Billie Ray, 76, said to reporters, “It seemed like Johnson & Johnson didn’t pay attention. It seemed like they didn’t care.”
Though Deborah Giannecchini faces a grim prognosis, she is clearly relieved to have achieved justice in this matter, which may give her a sense of peace. She said, “I’ve waited a long time for this. I’ve wanted this so badly.”
