Widower files Talcum Powder Fallopian Tube Cancer Lawsuit

In a recent wrongful death lawsuit filed in Minnesota, a man claims that his wife’s death from fallopian tube cancer could have been avoided had Johnson & Johnson provided warning of the possible link between cancer and perineal application of their talcum powder products.
On October 11, Edward Spenny filed a talcum powder lawsuit on behalf of himself and his late wife, Gladys Spenny, in the U.S. District Court for the District of Minnesota. According to Mr. Spenny, his wife used Johnson & Johnson talcum powder for feminine hygiene on a daily basis for more than 50 years, and this perineal application of talc led to the development of her fatal cancer of the fallopian tubes in 2013.
Like the more than 2,000 additional plaintiffs in talcum powder cancer lawsuits, Spenny alleges that Johnson & Johnson had access to scientific research dating back to the 1970s in which a possible link between genital application of talcum powder and gynecologic cancer was identified. Had J&J exhibited proper diligence, plaintiffs allege, they would not only have been aware of the more than 20 epidemiological studies linking talc with cancer of the female reproductive organs, but they would have warned consumers of this possible risk.
In addition to claiming that J&J should have been aware of studies suggesting perineal application of talcum powder may increase a woman’s risk of cancer, Spenny also cites a specific instance from 1994 where company officials were clearly and explicitly warned of this risk. That year, the Cancer Prevention Coalition issued a letter to the CEO of Johnson & Johnson drawing attention to recent research from Harvard doctors who discouraged the use of talcum powders for feminine hygiene due to the possible risk of ovarian cancer. The letter goes on to warn that ovarian cancer kills roughly 14,000 women each year and is especially difficult to detect and treat. In conclusion, the letter encouraged J&J to replace talc in their body powders with cornstarch, or at the very least, to warn consumers of the possible link between talcum powder and cancer.
Earlier this month, the U.S. Judicial Panel on Multidistrict Litigation (JPML) issued a transfer order to centralize all talcum powder cancer lawsuits filed in federal courts before a single judge in New Jersey as a multidistrict litigation (MDL). While the majority of these lawsuits are based on claims that use of talcum powder for feminine hygiene led to a diagnosis with ovarian cancer, a number of plaintiffs have based their claims on other gynecologic cancers such as endometrial cancer and Mr. Spenny’s claim of fallopian tube cancer. These plaintiffs argue that the same mechanism which allows tiny talc particles to infiltrate ovarian tissue may also cause cell mutations in other reproductive organs that may lead to cancer.
