Third Talcum Powder Lawsuit Trial underway in Missouri State Court

Despite attempts made by Johnson & Johnson to delay litigation by remanding a California woman’s talcum powder lawsuit to federal courts, this case is proceeding in a state court in St. Louis and jury selection is underway.
One week before the trial for Deborah Giannecchini’s talcum powder ovarian cancer lawsuit was scheduled to begin in a Missouri state court, Johnson & Johnson made what some call a desperate bid to have the case moved to a federal court. Ms. Giannecchini, from Modesto, California, originally filed her lawsuit in June 2014 and has waited more than two years for her trial to commence.
This case is scheduled to be the third bellwether trial in a joint lawsuit filed by 64 individuals against Johnson & Johnson. The two previous cases to go to trial in St. Louis both ended in massive multi-million dollar verdicts for the plaintiffs. In a petition to remove the case to a federal court, J&J argued that the claims were not sufficiently related to be joined together. The cosmetic manufacturer also attempted to have these cases disbanded in 2014, but at that time a judge ruled that there was no fraudulent misjoinder and they were allowed to proceed. J&J also noted that the U.S. Judicial Panel on Multidistrict Litigation is scheduled to consider the formation of a talcum powder lawsuit MDL on September 29, and that it would be appropriate to delay Giannecchini’s trial until this decision is made.
In response to this petition by J&J, Giannecchini’s attorneys filed an emergency motion to keep her case in a St. Louis circuit court. Her attorneys argued that, especially in light of the 2014 ruling to allow these cases to proceed united, J&J knew removal of the case was unlikely and simply filed this petition to delay the trial. Furthermore, Ms. Giannecchini’s ovarian cancer has progressed to such an advanced stage that her attorneys argued she may not survive until her trial is rescheduled, which could take months or more.
In a hearing last week, U.S. District Judge Jean C. Hamilton ruled that Giannecchini’s trial would proceed as planned in St. Louis.
The Montgomery Advertiser states that Deborah Giannecchini was diagnosed with ovarian cancer in 2012 after using talcum powder for feminine hygiene for roughly 46 years. Like other plaintiffs, she claims that J&J had been warned that talcum powder may increase a woman’s likelihood of developing ovarian cancer. Not only did the manufacturer allegedly fail to warn of possible talc cancer risks, but they actively took steps to hide this risk, according to plaintiffs.
J&J has long claimed that the many studies finding a possible link between ovarian cancer and perineal application of talcum powder are inaccurate and do not present conclusive evidence of this link. However, Giannecchini’s attorney states, “The regulations that apply to cosmetic companies require a warning if the product may possibly be associated with a hazard. Whether you think there’s a causal connection or not, there is certainly enough evidence to show a possible risk of ovarian cancer, and they’re just not warning about it.”
To prove this to a jury, attorneys have gathered a series of internal J&J memos, including one where a paid medical consultant warns company officials to stop denying the results of studies that draw a correlation between talc and ovarian cancer. In one memo from 1997, this consultant states, “Anybody who denies this risks that the talc industry will be perceived by the public like it perceives the cigarette industry: denying the obvious in the face of all evidence to the contrary.”
These memos were also presented to the juries in the two recent talcum powder trials won by plaintiffs. Giannecchini’s attorney states, “This jury saw them, read them and (the documents) really indicted Johnson & Johnson of extremely callous, reckless, intentional conduct that had to hurt people.”
By now, so many women and grieving families have filed talcum powder cancer lawsuits against Johnson & Johnson that some argue it would be foolish for the company to continue to deny negligence in their failure to warn of this risk. Especially after two massive verdicts against J&J, it may benefit the company at this point to propose settlement agreements rather than risk millions of dollars in jury trials.
