The First Talcum Powder Ovarian Cancer Lawsuit

Since the announcement of two massive verdicts totaling $127 million in judgments against Johnson & Johnson for their alleged negligence in hiding the risk of ovarian cancer associated with genital application of their talcum powder products, the possible link between talc and gynecologic cancer has been big news. What many people may not know, though, is that the first woman to file such a lawsuit against J&J in 2009 turned down a massive offer from the company in return for her silence on the issue and ended up with no compensation at all.
The Huffington Post recently shared the story of Diane Berg, a physician assistant from South Dakota who filed a talcum powder cancer lawsuit against J&J in 2009. Berg claims that she used talcum powder products such as Johnson’s Baby Powder and Shower-to-Shower for most of her life to alleviate feminine odors, and like thousands of other women, had no idea this may jeopardize her health. When Berg was diagnosed with ovarian cancer at the age of 49 in 2006, she learned through Internet research that while she did not have other common risk factors for ovarian cancer such as a family history, endometriosis, or infertility, she did have a habit of using talc products for feminine hygiene for decades—and this application had long been associated with a possible increased risk of cancer.
Berg told the New York Times in May 2016 that after learning of the alleged link between talc and cancer, “I went into the bathroom, I grabbed my Johnson’s Baby Powder and threw it in the wastebasket. I said, ‘What else could it be?'” When Berg then learned that scientific studies from as early as 1971 had warned J&J and other makers of talc body powder products that genital application of talc may increase the risk of ovarian and cervical tumors, she knew she had to take action—not only to hold J&J accountable for their negligence but also to warn the thousands of other women who may be putting themselves at risk for a deadly disease without knowing it.
Berg filed her talcum powder lawsuit against Johnson & Johnson in 2009, and J&J offered her a deal in 2013. The company told her that they would pay her $1.3 million if she would drop all accusations against them. Perhaps Berg considered taking the offer for a short time, but when she realized that this settlement was contingent on her signing a confidentiality clause preventing her from speaking out about talcum powder ovarian cancer, she knew she would never take it. As she now says, “It was never about the money.” So Berg proceeded with her lawsuit, and a South Dakota jury confirmed her allegations that J&J had withheld warnings about he risk of talcum powder cancer. However, she was awarded no monetary compensation, even for her medical expenses.
After her diagnosis with Stage 3 ovarian cancer, Berg told the New York Post that the cancer had already metastasized to her lymph nodes and she was given less than five years to live. She underwent a full hysterectomy and an intensive course of chemotherapy, and is grateful that she lived to see the day when, 10 years after her operation, the family of a woman named Jacqueline Fox was awarded $72 million in a talcum powder cancer lawsuit against J&J. She says she felt vindicated when “Jurors found Johnson & Johnson liable for fraud, negligence and conspiracy after lawyers argued that the company knew about the dangers but did nothing to inform customers.”
Now, says Berg, “My case paved the way for plaintiff lawyers to bring claims for hundreds of women who blame their ovarian cancer on exposure to talcum powder. As my lawyer said, I’m the equivalent of the first smokers who sued tobacco companies because of their lung cancer. The pioneers didn’t receive compensation, but the dangers and the conspiracy were finally exposed. Now I hope the family of Mrs. Fox will be the first of many to be awarded damages. Some people think $72 million is excessive, but I don’t think so. How can you put a value on a life?”
In addition to the family of Jacqueline Fox, another woman diagnosed with ovarian cancer named Gloria Ritesund was awarded $55 million in a talcum powder cancer lawsuit earlier this year—and thousands of related lawsuits are still pending.
