Talcum Powder Lawsuits to be Centralized as MDL in New Jersey

Last week, the U.S. Judicial Panel on Multidistrict Litigation (JPML) heard oral arguments for and against the centralization of all talcum powder cancer lawsuits filed in federal courts before a single judge for pretrial proceedings. On Tuesday, the panel announced the formation of the talcum powder lawsuit multidistrict litigation (MDL), which will be overseen by a New Jersey District Judge.
The JPML issued a transfer order to centralize all federal talcum powder cancer lawsuits before U.S. District Judge Freda L. Wolfson in the U.S. District Court for the District of New Jersey on Tuesday, October 4.
When multiple plaintiffs file lawsuits in federal courts against the same defendant based on common claims and questions of fact, there may be a number of benefits gained by the formation of an MDL. Not only will the centralization of these claims before a single judge reduce duplicative discovery, but it will also prevent conflicting rulings from separate judges and serve the convenience of all parties involved in the litigation.
In the case of the newly-formed talcum powder MDL, plaintiffs claim to have suffered personal injury or the wrongful death of a loved one due to ovarian or gynecologic cancer caused by perineal application of talc-based body powders. They also allege that Johnson & Johnson, a leading provider of talc powder products including Johnson’s Baby Powder and Shower-to-Shower, was warned that genital application of talcum powder may significantly increase the risk of cancer as early as 1971, but chose not to extend such warnings to consumers. It is this willful failure to warn, allege plaintiffs, which led to the diagnosis of thousands of women with aggressive and potentially fatal cancers.
The petition for a talcum powder lawsuit MDL was filed by a plaintiff named Tanashiska Lumas in July, and Lumas sought to have the MDL held in an Illinois court. A number of plaintiffs in talcum powder cancer lawsuits expressed opposition to the formation of an MDL. Some of these plaintiffs stated that their own lawsuits were already at such advanced stages that the formation of an MDL would be inconvenient for them and slow the justice process. Other plaintiffs believed that some of the claims proposed for the MDL were filed based on different causes of action, so that it would not be suitable to combine them. Still other plaintffs stated that they may support the idea of an MDL, but would prefer to centralize the claims in a different court from the one proposed by Lumas. Johnson & Johnson was also not opposed to the formation of an MDL, but wanted the cases to be consolidated in either Oklahoma or New Jersey, where they and other defendants were headquartered.
The JPML ruled that the roughly three-dozen separate talcum powder lawsuits pending in more than 23 districts were based on claims common enough to warrant consolidation, stating, “The majority of the actions are personal injury or wrongful death actions brought by plaintiffs who allege that they or their decedents developed ovarian or uterine cancer following perineal application of Johnson & Johnson’s talcum powder products…All the actions involve factual questions relating to the risk of cancer posed by talc and talc-based body powders, whether the defendants knew or should have known of this alleged risk, and whether defendants provided adequate instructions and warnings with respect to the products.” The JPML also found that many plaintiffs’ arguments against the formation of an MDL were not persuasive enough to prevent the transfer.
In accordance with the wishes of J&J, the JPML ruled that the talcum powder MDL will be held in New Jersey. They state in the transfer order, “We select the District of New Jersey as the appropriate transferee district for this litigation. The district is a convenient and accessible forum for this nationwide litigation, and is located in close proximity to a large number of state court actions pending in New Jersey and other jurisdictions on the East Coast of the United States. As Johnson & Johnson is headquartered in New Jersey, relevant evidence and witnesses likely are located in the District of New Jersey.” U.S. District Judge Wolfson was selected to preside over pretrial proceedings as a result of her experience with MDLs as well as her experience with previous talcum powder lawsuits.
In MDLs, it is common for judges to establish a schedule for bellwether trials once discovery is completed. Cases selected for bellwether trials feature claims, evidence, and testimony likely to be used in a larger number of claims, and so jury verdicts for bellwether trials help attorneys to predict similar results in other cases. Often, verdicts in bellwether trials lead to settlements for other claims. Once pretrial proceedings are completed for an MDL, all unsettled claims will be remanded back to the courts where they were originally filed for individual trials.
In addition to the talcum powder cancer lawsuits centralized in this MDL, there are also thousands of similar claims pending in state courts—mostly in St. Louis, Missouri where a number of multi-million awards have already been issued to plaintiffs.
