Some Plaintiffs in Talcum Powder Lawsuits May Testify Early

The U.S. District Judge overseeing consolidated pretrial proceedings for a growing number of personal injury lawsuits based on claims that plaintiffs have suffered as a result of ovarian cancer caused by genital application of talcum powder products has taken under consideration a factor that makes this litigation unique: many of the plaintiffs involved may not survive long enough to testify. To that end, U.S. District Judge Freda L. Wilson recently established protocols to ensure that the testimony of terminal plaintiffs is preserved.
Judge Wolfson was appointed to oversee the multidistrict litigation (MDL) centralizing all talcum powder cancer lawsuits filed in federal courts in the U.S. District Court for the District of New Jersey. When multiple plaintiffs file lawsuits in separate district courts against the same defendant and based on common questions of fact, the formation of an MDL helps to prevent duplicative discovery and conflicting rulings, and it also serves the convenience of all parties involved. When the talcum powder cancer MDL was established in October 2016, roughly three-dozen lawsuits were centralized before Judge Wolfson, and this number is expected to grow.
In the talcum powder lawsuits before Judge Wolfson, plaintiffs claim that Johnson & Johnson and other defendants had cause to know that perineal application of talcum powder may significantly increase a woman’s risk of developing ovarian cancer, but that they intentionally withheld warnings of this risk. Plaintiffs have cited more than 22 epidemiological studies conducted since the early 1980s in which scientists identified a link between talcum powder and gynecologic cancers. It has also been revealed in previous talcum powder lawsuits through leaked J&J memos that company executives discussed ways to prevent news of the possible link between their products and cancer from reaching consumers and affecting their profits.
Ovarian cancer is often not symptomatic until the cancer has reached an advanced stage, which is one reason that this disease is associated with a fairly poor survival rate. The American Cancer Society reports that only about 45% of women survive five years after being diagnosed with ovarian cancer. Due to the aggressive nature of this disease, it is likely that a number of the plaintiffs involved in the litigation before Judge Wolfson will not live long enough to participate in their own trials, so she needed to establish procedures to enable them to testify early.
On January 23, Judge Wolfson issued an order detailing procedures for the scheduling of “In Extremis” depositions for plaintiffs in talcum powder lawsuits. The term “In Extremis” is used to refer to the final illness before death, and in legal matters it is necessary to establish that the declarant is in imminent risk of death and to properly document their “deathbed confessions”. Judge Wolfson says that plaintiffs must provide a letter from their healthcare provider and medical records as proof that they have no hope of recovery before granting In Extremis deposition. Most plaintiffs will be given 60 days to schedule depositions, but the schedule may be expedited when necessary.
