Plaintiffs Continue to File Talcum Powder Ovarian Cancer Lawsuits

Despite the fact that recent scientific studies deny the link between talcum powder and ovarian cancer and the recent dismissal of two talc lawsuits by a judge who found plaintiffs were unable to present scientific evidence to prove this link, women in the United States and in Canada continue to file talcum powder lawsuits.
Earlier this month, Bloomberg reported that a New Jersey judge ruled to dismiss two talcum powder lawsuits in which plaintiffs claimed genital application of talc products caused them to develop ovarian cancer. According to Judge Nelson Johnson of Atlantic City, attorneys for these women failed to produce sufficient evidence in the form of medical and scientific research that proved use of talcum powder may increase women’s risk of cancer.
This was good news for Johnson & Johnson, the maker of some of the world’s most popular talc-based body powders such as Johnson’s Baby Powder and Shower-to-Shower. J&J has already lost two talcum powder lawsuits this year, and both ended in multi-million dollar verdicts against the manufacturer by juries that were convinced J&J took steps to hide the possible link between talc and cancer. These verdicts brought increased notoriety to this issue, and now J&J is facing well over 1,000 talcum powder ovarian cancer lawsuits brought by individuals who seek to hold them accountable for their willful failure to warn of cancer risks.
Following one of these trials, a representative of J&J said, “Unfortunately, the jury’s decision goes against 30 years of studies by medical experts around the world that continue to support the safety of cosmetic talc.” In fact, Fox News recently reported that “Most research finds no link or a weak one between ovarian cancer and using baby powder for feminine hygiene…Most major health groups have declared talc harmless.”
However, while it may be true that the official position of most major health groups are similar to that of the National Cancer Institute, that there is no clear connection between talc and ovarian cancer, it is also equally true that it is impossible to scientifically disprove this allegation. While some studies conclude that talc does not increase the risk of ovarian cancer, others have found quite a significant association between the product and the disease. There are at least 20 epidemiological studies dating back to 1971 in which researchers found a correlation between genital application of talcum powder and gynecologic cancers.
Ovarian cancer is an aggressive form of cancer, but it is also not very common. Due to the rareness of this form of cancer, it is difficult to accurately research and determine which risk factors may or may not increase a woman’s likelihood of developing it.
In most talcum powder cancer lawsuits, plaintiffs blame J&J for failing to warn of a risk of ovarian cancer. Really, the task before plaintiffs’ attorneys may not be to prove that talc does cause cancer. Instead, they must show juries that J&J and other companies had been warned that use of talcum powder may cause cancer, yet failed to extend this warning to consumers. Through this warning, consumers would have been able to decide for themselves if using talcum powder for feminine hygiene outweighed any possible risks, whether those risks were proven facts or not.
In previous talcum powder lawsuits which have ended in the favor of plaintiffs, attorneys have presented internal J&J documents that show company officials discussed the scientific claims regarding a possible link between talc and ovarian cancer, and that they went on to discuss how to prevent these claims from affecting their profits.
Regardless of whether the most recent scientific studies confirm that genital application of talcum powder may increase the risk of cancer, thousands of women and their loved ones continue to believe that J&J was negligent in failing to warn of risks, even if they were only suspected risks.
