Plaintiffs Accuse J&J of “Calculated and Reprehensible Conduct” in Talcum Powder Lawsuit

In a recently filed talcum powder lawsuit, husband and wife plaintiffs accuse Johnson & Johnson and other defendants of “calculated and reprehensible conduct” due to their willful failure to warn of potential talcum powder ovarian cancer risks.
According to the talcum powder lawsuit filed on December 9 by Julie Segreaves and her husband, John Segreaves, Julie Segreaves used Johnson’s Baby Powder and Shower-to-Shower for most of her life. Like countless other women, Segreaves states that she used these talcum powder products to maintain “personal freshness,” a purpose for which the defendants expressly promoted them, by sprinkling these powders on her perineal area. She claims that defendants, including Johnson & Johnson, Imerys Talc America, the Personal Care Products Council, and others, knew for decades that scientific research had linked genital application of talc to an increased risk of ovarian cancer. Had these entities honored their duty to warn consumers of even a potential risk of cancer, Segreaves claims that she would have discontinued use of talcum powder products for feminine hygiene. Segreaves and her husband allege that it is as a direct result of this “calculated and reprehensible conduct” that she was diagnosed with ovarian cancer at the age of 53 in December 2014.
In her complaint, Segreaves states, “This action arises out of the Plaintiff Julie Segreaves’ diagnosis of ovarian cancer, which was directly and proximately caused by her regular and prolonged use of talcum powder containing products known as Johnson & Johnson Baby Powder and Shower to Shower in the perineal area…Plaintiff’s damages are a direct and proximate result of Defendants’ and/or their corporate predecessors negligent, willful, and wrongful conduct in connection with the design, development, manufacture, testing, packaging, promoting, marketing, distribution, labeling, and/or sale of the products.”
These allegations echo those of more than 2,000 plaintiffs in talcum powder cancer lawsuits, many of which were recently centralized before a single New Jersey judge for coordinated pretrial proceedings as part of a multidistrict litigation (MDL). In addition to these claims filed in federal courts, there are also roughly 65 similar lawsuits pending in St. Louis, Missouri. Due to a loophole in Missouri law, plaintiffs from other states may combine their lawsuits with related lawsuits if one of those lawsuits was filed by a Missouri resident. St. Louis has become something of a hot-spot in the matter of talcum powder litigation, especially since St. Louis juries have awarded numerous multi-million dollar awards to plaintiffs in talc lawsuits.
In all of these talcum powder lawsuits, plaintiffs cite scientific research dating as far back as the 1970s in which perineal application of talc was associated with an increased risk of ovarian or gynecologic cancers. They also document internal J&J memos where company executives discuss the potential link between talc and cancer and how to prevent public knowledge of this link from affecting their profits, as well as letters addressed specifically to that and other companies encouraging them to warn of talc cancer risks.
