Plaintiff seeks Class Action for Talcum Powder Ovarian Cancer Lawsuits

In one of the most recently filed talcum powder ovarian cancer lawsuits, the plaintiff seeks class action status. This would allow all plaintiffs with related complaints to join in a single lawsuit against Johnson & Johnson, the company behind the most frequently used talcum powder products.
In a talcum powder lawsuit filed on September 7 in the U.S. District Court for the Middle District of Louisiana, Shintelle Joseph requests class action status on the grounds that hundreds or even thousands of other women are currently seeking or will seek compensation from Johnson & Johnson for alleged failure to warn of known talcum powder ovarian cancer risks.
According to Joseph’s complaint, she has been using talcum powder for personal feminine hygiene for roughly 20 years, since she was 17 years old. She alleges that her diagnosis with ovarian cancer in 2006 may have been avoided had J&J provided adequate warning about the possible link between their talc body powder products like Johnson’s Baby Powder and Shower-to-Shower and gynecologic cancer. She also alleges that J&J had cause to know of this risk for decades.
Shintelle Joseph is not alone in making these allegations against Johnson & Johnson. In other talcum powder ovarian cancer lawsuits, plaintiffs have alleged that the manufacturer was alerted to the possible link between genital application of talc and ovarian cancer as early as 1971, when researchers in Britain found talc particles in 75% of the ovarian cancer tumors they dissected. Since then, there have been more than 20 epidemiological studies which have drawn a correlation between use of talcum powder for feminine hygiene and an increased risk of cancer. However, despite these possible risks, J&J continued to promote their talc powder products for feminine hygiene uses and never added any warnings of this risk to product labels. In fact, some plaintiffs have even presented internal J&J memos discussing how to keep reports of the link between talc and cancer from adversely affecting their profits.
Shintelle Joseph claims that the numbers of talcum powder ovarian cancer lawsuits filed in the United States may grow so high that it is only practical to establish a class for these actions. She says, “The members of the Class are so numerous and geographically dispersed that joinder is impractical. Plaintiffs believe that the Class includes hundreds if not thousands of persons and spouses of persons who have developed ovarian cancer as a result of the prolonged use of talcum powder based products, and that the locations of such persons is geographically dispersed throughout the country.”
Later this month, the United States Judicial Panel on Multidistrict Litigation (JPML) will hear arguments regarding the formation of a talcum powder lawsuit multidistrict litigation (MDL). This would centralize all such lawsuits filed in federal courts before a single judge for pretrial proceedings.
The formation of a talcum powder class action lawsuit would differ from the proposed MDL in a number of ways. First, an MDL centralizes federal lawsuits, not lawsuits filed at the state level, for pretrial proceedings. This may prevent duplicative discovery and streamline the early justice process for all parties involved, but the cases in an MDL remain separate. This means that any cases that go before a jury will be tried individually. In a class action lawsuit, all plaintiffs join in a single action and any award is issued to the group as a whole. Individual compensation in such class actions is usually based on factors such as personal suffering and damages, duration of illness, loss of a loved one, and others.
Two multi-million dollar jury verdicts favoring plaintiffs in talcum powder ovarian cancer lawsuits earlier this year have drawn considerable attention to the possible link between talc and cancer, as well as to J&J’s alleged negligence in failing to warn of this link.
