Plaintiff Names Walgreens as Defendant in Talcum Powder Lawsuit

The defendants most frequently named in the more than 3,000 talcum powder cancer lawsuits pending in courts across the United States are leading talc product manufacturer Johnson & Johnson, their supplier, Imerys Talc America, and the Personal Care Products Council. However, in a recent lawsuit the plaintiffs also name the retail chain Walgreens as a defendant, and if their allegations hold weight this company may figure more prominently in future talcum powder lawsuits.
In a talcum powder cancer lawsuit filed on March 1 in Cook County (Ill) Circuit Court, Andrea Harris and her husband, Bart Harris claim that J&J talcum powder products purchased at Walgreens stores caused Mrs. Harris to develop ovarian cancer.
Like other plaintiffs in talcum powder lawsuits, Andrea Harris and her husband claim that Johnson & Johnson knew or should have known that products like Johnson’s Baby Powder and Shower-to-Shower may significantly increase a woman’s risk of developing gynecologic cancer. Since 1971, there have been more than 20 epidemiological studies in which researchers identified a possible causal link between genital application of talcum powder and ovarian cancer and other malignancies. Furthermore, the United States National Toxicology Program categorized talcum powder as a carcinogen in 1993.
Despite the massive body of evidence linking talcum powder with cancer, J&J and others allegedly intentionally withheld warnings of this risk in order to protect their own profits. Moreover, Johnson & Johnson continued to specifically promote their products for perineal application for feminine hygiene purposes. As the Harris lawsuit states, products like Shower-to-Shower were marketed directly to women to help them “feel soft, fresh and comfortable.”
Multiple plaintiffs have also claimed that J&J, Imerys Talc America, and other key players in the cosmetic talc industry even conspired to prevent regulation of talc as a possible carcinogen, but it is unknown how many plaintiffs have alleged that Walgreens was part of this alleged conspiracy. Crain’s Chicago Business reports that in the Harris talc lawsuit, the plaintiffs claim that Walgreens not only sold potentially dangerous talc products made by Johnson & Johnson, but that they actively worked together to encourage the purchase of talcum powder despite known risks.
According to the lawsuit filed by Andrea and Bart Harris, Walgreens and J&J share an office in Buffalo Grove, Illinois where they develop marketing plans to promote products like talcum powder specifically to Walgreens shoppers. The lawsuit claims, “J&J and Walgreens implement strategies to influence consumers’ purchase of J&J baby powder products from Walgreens, including through data analytics of customers’ purchases and loyalty and rewards programs.” The Harris’ claim that Walgreens worked from this office shared with J&J to test products for safety and also to create labels, promotional materials, and ad campaigns to encourage the use of talcum powder for feminine hygiene.
Andrea Harris says that she purchased and used J&J talcum powder products from Walgreens from 1980 through 2014. She goes on to state that she always read product labels for any safety warnings, and since there were no warnings she believed the talcum powder to be safe to use. Had she known of the potential link between talc and ovarian cancer, she says, she would have immediately discontinued use. She was diagnosed with ovarian cancer in 2016 for which she is still being treated. Harris seeks compensation for economic losses for medical care and lost wages, physical and mental suffering, loss of enjoyment of life, and other damages.
The lawsuit filed by Mr. and Mrs. Harris is one of more than 3,000 talcum powder lawsuits currently pending in the United States. In three of the four claims that have gone to a jury trial, plaintiffs were awarded multiple millions of dollars for their suffering and damages.
