Plaintiff files Motion for Talcum Powder Cancer MDL

A woman who recently filed a talcum powder ovarian cancer lawsuit against Johnson & Johnson (J&J) has also filed a motion for all related talcum powder lawsuits pending in federal courts to be centralized before a single judge as a multidistrict litigation (MDL).
In her talcum powder lawsuit filed on July 1 in the U.S. District Court for the Southern District of Illinois, Tanashiska Lumas claims that she was diagnosed with ovarian cancer as a result of “regular and prolonged exposure to talcum powder” through products for personal hygiene. She also claims that the makers of talc body powder products such as Johnson’s Baby Powder and Shower-to-Shower, J&J and Johnson & Johnson Consumer Companies, knew that genital application of talc products may substantially increase the risk of ovarian cancer and failed to warn of this risk.
Since the recent multi-million dollar verdicts awarded to two plaintiffs in talcum powder lawsuits in which it was claimed that J&J and other companies knew genital application of talc may cause ovarian or gynecologic cancer and not only failed to warn of this risk but actively sought to hide it from consumers, the number of talc cancer lawsuits filed has increased in the United States. Here, women who have been diagnosed with ovarian or uterine cancer after using talcum powder products for decades to reduce moisture and control personal odor, or families who have lost a loved one to talcum powder cancer, cite the more than 20 epidemiological studies linking talc to cancer since the 1970s. Some plaintiffs have also produced internal company documents from J&J in which company officials discuss the alleged risk of talcum powder cancer and how to keep this potential risk from damaging their profits.
Now, so many talcum powder ovarian cancer lawsuits have been filed against J&J that Tanashiska Lumas believes it will serve the convenience of all parties involved to centralize these lawsuits before a single judge for pretrial proceedings. Reuters reports that on n July 15, Lumas submitted a motion for transfer with the U.S. Judicial Panel on Multidistrict Litigation (JPML), asking that all federal talc cancer lawsuits be consolidated in the Southern District of Illinois.
According to Lumas’ motion, there are currently 11 separate talcum powder ovarian cancer lawsuits pending against J&J in federal courts, as well as thousands of additional lawsuits underway at the state level. She also claims that the number of federal lawsuits based on claims of talcum powder cancer will only increase in the coming months.
By centralizing all of these talcum powder lawsuits for pretrial proceedings, it will allow attorneys for both sides to avoid duplicate discovery, dramatically reducing the necessary research and streamlining many aspects of early litigation. The formation of an MDL will also prevent conflicting rulings form separate judges and serve the convenience of all parties involved. Once the initial stages of litigation are completed, the judge overseeing this proposed MDL may call for a number of “test”, or bellwether trials to help attorneys gauge likely jury responses to common evidence and testimony. This could lead to settlements in a greater number of claims. If not, individual cases may be remanded back to the District Courts where they were first filed.
Now that a motion for transfer has been filed with the JPML, the next step is for a panel to hear oral arguments for and against centralization of all federal talcum powder lawsuits. This will likely happen in the next few months.
