Mother files Talcum Powder Lawsuit after Losing Daughter to Ovarian Cancer

The majority of the wrongful death lawsuits recently filed against talcum powder manufacturer Johnson & Johnson have been filed by adult children who lost mothers to ovarian cancer they believe was caused by use of talc body powder products. In an especially tragic twist, however, a mother recently filed talcum powder lawsuit after losing her daughter to ovarian cancer.
On October 12, Lucy Tetlow filed a wrongful death lawsuit on behalf of her deceased daughter, Laurie Tetlow. According to Tetlow’s complaint, Johnson & Johnson, their talc supplier Imerys Talc America, and other defendants acted in fraudulent negligence and civil conspiracy when they allowed and encouraged consumers like her daughter to use talcum powder for feminine hygiene purposes after they had known for years that this use may increase the risk of ovarian cancer. Laurie Tetlow suffered severely before she succumbed to ovarian cancer on November 4, 2015.
Like the growing number of plaintiffs in talcum powder lawsuits, Tetlow alleges that J&J and other defendants had cause to be aware since as early as 1971 that genital application of talc may increase the risk of ovarian cancer, yet they failed to warn of this risk. Furthermore, in addition to more than 20 epidemiological studies drawing an association between talc and ovarian cancer, J&J and other defendants were specifically warned of this risk through a letter from the Cancer Prevention Coalition. They were also encouraged to protect the wellbeing of their consumers by using cornstarch instead of talc for their body powders, or at the very least, to post warnings of possible talcum powder cancer risks.
Also like plaintiffs in other talcum powder lawsuits, Tetlow alleges that J&J intentionally promoted their Johnson’s Baby Powder and Shower-to-Shower for perineal application despite knowledge of cancer risks. She says, “Historically, ‘Johnson’s Baby Powder’ has been a symbol of freshness, cleanliness, and purity. During the time in question, the Johnson & Johnson Defendants advertised and marketed this product as the beacon of ‘freshness’ and ‘comfort’, eliminating friction on the skin, absorbing ‘excess wetness’ helping keep skin feeling dry and comfortable, and ‘clinically proven gentle and mild’. The Johnson & Johnson Defendants compelled women through advertisements to dust themselves with this product to mask odors. The bottle of ‘Johnson’s Baby Powder’ specifically targets women by stating, ‘For you, use every day to help feel soft, fresh, and comfortable.'”
So far, the allegations made in Tetlow’s lawsuit are very similar to those made in the thousands of other lawsuits currently pending against J&J, Imerys Talc, and others. In addition to the fact that Tetlow has filed on behalf of her deceased daughter, though, this lawsuit is unique in that the plaintiff accuses the defendants of “Civil Conspiracy.” She claims that the companies formed the Talc Interested Party Task Force (TIPTF), a group whose goal was to maintain profits from talc despite possible cancer risks. According to Tetlow, “[The] purpose of the TIPTF was to pool financial resources of these companies in an effort to collectively defend talc use at all costs and to prevent regulation of any type over this industry. The TIPTF hired scientists to perform biased research regarding the safety of talc, members of the TIPTF edited scientific reports of the scientists hired by this group prior the submission of these scientific reports to governmental agencies, members of the TIPTF knowingly released false information about the safety of talc to the consuming public, and used political and economic influence on regulatory bodies regarding talc.”
As a result of these and other egregious acts of negligence, Tetlow claims that J&J and other defendants directly brought about her daughter’s diagnosis with ovarian cancer, suffering, and untimely death. She seeks compensation for not only her daughter’s suffering, but also for her own.
