Man files Talcum Powder Wrongful Death Lawsuit after losing Mother

In one of the most recent talcum powder ovarian cancer lawsuits filed against Johnson & Johnson, a grieving son claims that his mother’s death from cancer would have been avoided had J&J disclosed what they had been warned of for many years: that genital application of talcum powder may increase the risk of gynecologic cancer.
According to the talc lawsuit filed on August 1 by Kenneth Batiste in the U.S. District Court for the Western District of Louisiana, his mother, Deiadria, would never have used talcum powder for feminine hygiene purposes if she had known that this may increase her risk of developing cancer. However, he claims, since J&J willfully withheld warnings of this risk, and his mother used Johnson’s Baby Powder and Shower-to-Shower for her entire life. Deiadria Batiste was diagnosed with ovarian cancer at the age of 48, and she died four years later in 2015.
Like other plaintiffs in talcum powder cancer lawsuits, Batiste alleges that J&J not only failed to warn of the risk of talcum powder ovarian cancer, but that they specifically marketed their products with the implication that they should be applied to female genitals—the very use which may bring about an increased risk of cancer. Moreover, he claims, J&J was aware that “At all pertinent times, a feasible alternative to the Products has existed. For example, cornstarch is an organic carbohydrate that is quickly broken down by the body with no known health effects.” However, Batiste and other plaintiffs allege that J&J chose to continue using talc for their body powder products.
Mr. Batiste claims in his lawsuit that, despite more than 23 epidemiologic studies published since 1982 “providing data regarding the association of talc and ovarian cancer,” Johnson & Johnson continued to specifically market multiple talc-based body powder products for feminine hygiene purposes. He states,
Historically, “Johnson’s Baby Powder” has been a symbol of freshness, cleanliness, and purity. During the time in question, the Johnson & Johnson Defendants advertised and marketed this product as the beacon of “freshness” and “comfort”, eliminating friction on the skin, absorbing “excess wetness” helping keep skin feeling dry and comfortable, and “clinically proven gentle and mild.” The Johnson & Johnson Defendants instructed women through advertisements to dust themselves with this product to mask odors. The bottle of “Johnson’s Baby Powder” specifically targets women by stating, “For you, use every day to help feel soft, fresh, and comfortable.” During the time in question, the Johnson & Johnson Defendants advertised and marketed the product “Shower to Shower” as safe for use by women as evidenced in its slogan “A sprinkle a day keeps odor away”, and through advertisements such as “Your body perspires in more places than just under your arms. Use SHOWER to SHOWER to feel dry, fresh, and comfortable throughout the day.” And “SHOWER to SHOWER can be used all over your body.”
Sadly, Mr. Batiste is only one of a growing number of plaintiffs who claim to have suffered due to an ovarian cancer diagnosis they believe is directly related to J&J’s failure to warn of allegedly known talcum powder cancer risks. In fact, so many individuals have filed similar lawsuits in federal courts that a motion was recently submitted to centralize all of these lawsuits before a single judge for pretrial proceedings to make the justice process more convenient for all parties involved.
