Man Files Talcum Powder Lawsuit After Wife Dies of Ovarian Cancer

According to a recent personal injury lawsuit filed against Johnson & Johnson and other parties, a Tennessee woman died from ovarian cancer after using J&J talcum powder products for decades because the company neglected to warn of known risks.
In his talcum powder lawsuit, James Albertine, Jr. claims that Johnson & Johnson and other defendants knew of the possible risk of ovarian cancer associated with their talcum powder products, and intentionally withheld warnings of this risk for decades. Albertine goes on to allege that his wife, Anna Lea Albertine, would never have used Johnson’s Baby Powder for feminine hygiene had she been properly warned of possible cancer risks. Thus, he claims, it is as a direct and proximate result of the defendants’ failure to warn that his wife endured extensive pain and suffering for five years before dying from ovarian cancer in January 2015.
Like millions of other women, Anna Lea Albertine regularly used talcum powder on her perineal region to reduce moisture and odor. In fact, Mr. Albertine and other plaintiffs in recent talcum powder lawsuits claim that J&J intentionally promoted their Johnson’s Baby Powder for feminine hygiene purposes—and this was so successful that they developed their Shower-to-Shower product specifically to cater to female consumers and capitalize on this popular use of talcum powder.
However, it has recently come to public attention that J&J, their supplier, Imerys Talc America, and other parties were warned as early as 1971 that genital application of talcum powder may significantly increase a woman’s risk of developing ovarian cancer and other gynecologic cancers. In addition to having access to more than 25 epidemiological studies finding an association between use of talcum powder and ovarian cancer, it has also been alleged that in 1994 J&J was specifically warned of this risk of talc ovarian cancer by the Cancer Prevention Coalition and encouraged to protect consumers by using cornstarch instead of talc for their body powders. Furthermore, it is also alleged that J&J and others formed the Talc Interested Party Task Force specifically to pool resources in an effort to prevent any regulation of the talc industry and to prevent consumers from learning about potential ovarian cancer risks.
According to his lawsuit, Mr. Albertine believes that his wife would not have used talcum powder had J&J properly warned her of the potential risk of ovarian cancer associated with their product. Since she was never warned, he claims, she used J&J talc products for more than 30 years and was diagnosed with ovarian cancer in 2010. Mrs. Albertine suffered extensively for five years before she finally succumbed to this disease. Her husband claims, “Had Anne Albertine, Deceased, received a warning that the use of J&J Baby Powder would have significantly increased her risk of cancer, she would not have used the same. As a proximate result of Defendants’ design, manufacture, marketing, sale, and distribution of J&J Baby Powder, Anne Albertine suffered severe pain of mind and body for over five years and was diagnosed with a terminal disease that took her life.”
In recent years, there have been a number of multi-million dollar awards granted to plaintiffs in talcum powder cancer lawsuits, and this has prompted so many more claims that a multidistrict litigation (MDL) was formed last year to centralize all federal talc lawsuits before a single judge. Mr. Albertine’s wrongful death lawsuit will be consolidated with these claims in the U.S. District Court of New Jersey before U.S. District Judge Freda L. Wolfson for pretrial proceedings, along with dozens of additional claims. There are also thousands of similar talcum powder lawsuits pending in Missouri.
