Judge Rules on Two Talcum Powder Ovarian Cancer Lawsuits

Last week, a New Jersey judge issued a summary judgment which dismissed two talcum powder ovarian cancer lawsuits which were set to serve in bellwether trials beginning next month.
Bloomberg reports that Superior Court Judge Nelson Johnson of Atlantic City, New Jersey, ruled on Friday that the two plaintiff’s attorneys were unable to submit adequate evidence to prove that baby powder made by Johnson & Johnson caused their ovarian cancer diagnoses.
The lawsuits were filed by Brandi Carl and Diana Balderrama, who claimed that J&J had knowledge that genital application of talcum powder may cause or increase the risk of ovarian cancer for a number of decades, but that they intentionally sought to withhold this knowledge from the public.
Like at least 2,000 additional plaintiffs, these women demanded that J&J be held accountable for their gross negligence. Many of the talcum powder ovarian cancer lawsuits currently pending in the United States were filed on the heels of two multi-million dollar verdicts awarded to plaintiffs. In February, a St. Louis jury ruled in favor of claims made by the family of Jacqueline Fox that her fatal ovarian cancer was caused by use of J&J talc products, awarding them $72 million in punitive and compensatory damages. In May, a second jury in St. Louis awarded Gloria Ritesund $55 million when her lawyers showed them that “Internal documents from J&J show it knew of studies connecting talc use and ovarian cancer, but, to this day, it continues to market it as safe-neglecting any warning,” reported CNN Money.
Despite the fact that more than one talcum powder ovarian cancer lawsuit has ended in the plaintiff’s favor as a result of evidence and testimony presented in support of the possible carcinogenicity of talc, Judge Johnson stated that the plaintiffs’ lawyers presented evidence in support of the link between talc and cancer that suffered from “multiple deficiencies.” Thus, he stated, they failed to establish a clear causal link between genital application of talc products and gynecologic cancer. A spokeswoman for J&J stated in response to this ruling, “The court’s decision today appropriately reflects the science and facts at issue in this litigation. Science, research, clinical evidence and decades of studies by medical experts around the world continue to support the safety of cosmetic talc.”
Now, the majority of the talcum powder cancer lawsuits are pending in Missouri courts or in federal courts. Recently, a petition was submitted to the U.S. Judicial Panel on Multidistrict Litigation (JPML) to centralize all federal talc lawsuits before a single judge in a multidistrict litigation (MDL).
There are also more than 200 talcum powder cancer lawsuits pending before Judge Johnson in New Jersey, and his recent dismissal of two claims may set a dangerous precedent for other plaintiffs in his court. The lawsuits were filed in New Jersey because this is where Johnson & Johnson’s corporate headquarters are located. Still, attorneys representing Carl and Balderrama continue to believe they have gathered adequate evidence in support of their claims and intend to appeal Judge Johnson’s ruling.
Though last week’s ruling by Judge Johnson may be viewed as a setback by some plaintiffs, new plaintiffs continue to file talcum powder ovarian cancer lawsuits against J&J and their supporters remain hopeful that justice will be served.
