JPML to Hear Arguments on Talcum Powder Lawsuit Centralization Next Month

Since a plaintiff submitted a motion to transfer all talcum powder ovarian cancer lawsuits filed in federal courts to a single court for pretrial proceedings, numerous arguments have been made by both sides in favor of and in opposition to the formation of a talc lawsuit MDL (multidistrict litigation). It has recently been announced that the U.S. Judicial Panel on Multidistrict Litigation (JPML) will hear arguments regarding the proposed MDL next month.
According to a notice issued earlier this month by the JPML, oral arguments applying to the formation of a talcum powder lawsuit MDL will be heard on September 29 at the E. Barrett Prettyman United States Courthouse in Washington, D.C.
At this time, there are 11 lawsuits filed in 10 U.S. District Courts in which plaintiffs seek to hold Johnson & Johnson and other parties accountable for their alleged failure to warn of the link between genital application of talcum powder and ovarian cancer. In July Reuters reported that one of these plaintiffs, Tanashiska Lumas, filed a motion with the JPML to transfer all of these cases and any subsequent claims filed in federal courts to a single court in Illinois for pretrial proceedings.
When multiple plaintiffs file lawsuits based on common questions of fact against the same defendant, consolidating them as an MDL helps to reduce duplicative discovery, prevent conflicting rulings from separate judges, and is meant to serve the convenience of all parties involved.
However, some plaintiffs have already argued that the formation of a talcum powder lawsuit MDL is not appropriate in this case. A number of plaintiffs have stated that discovery in their individual claims has already been nearly completed, and that joining with other lawsuits in an MDL would cause them delays and make the justice process decidedly inefficient for them. Others have argued that some of the lawsuits proposed for the MDL are based on different causes of action, so centralization would be unsuitable. Still other plaintiffs support the idea of an MDL, but would prefer to have the lawsuits centralized in different courts than the one suggested by Lumas.
Johnson & Johnson, the main defendant in these talcum powder lawsuits, is also in favor of centralization but has suggested that the MDL be held in New Jersey, near their company headquarters, or in Oklahoma.
Though only 11 cases have been noted in the motion to transfer all federal talcum powder lawsuits to a single court for pretrial proceedings, it is highly likely that additional lawsuits will also be included in the MDL. Many women who have been diagnosed with ovarian cancer were not aware that their life-long use of talcum powder products for feminine hygiene may have caused their diagnoses until significant media coverage of two multi-million dollar verdicts in talc lawsuits alerted them to this possible link.
