J&J Seeks to Limit Discovery in Talcum Powder Cancer MDL

Since the formation of a multidistrict litigation (MDL) to coordinate pretrial proceedings for the growing number of talcum powder lawsuits filed in federal courts was approved in October 2016, two status conferences have been held. On February 22, a third status conference with U.S. District Judge Freda L. Wolfson in the District of New Jersey will be held to iron out issues regarding pretrial discovery and potential bellwether trial scheduling. In an agenda submitted prior to this conference, Johnson & Johnson and other defendants in this matter expressed a desire to limit discovery.
In a Joint Agenda submitted to Judge Wolfson on February 17, J&J and other defendants including talc supplier Imerys Talc America requested that discovery in the talcum powder cancer MDL be limited strictly to scientific and medical causation linking talcum powder use with ovarian cancer. If granted, this would mean that plaintiffs will not be allowed to present evidence on issues such as J&J and defendants’ alleged knowledge of talcum powder cancer risks, their communications about those risks, and other issues key to supporting their claims.
In talcum powder cancer lawsuits, plaintiffs allege that J&J and others knew for decades that genital application of talc products may significantly increase the risk of gynecologic cancer since at least 1971, yet they intentionally hid this risk from consumers to protect their own profits. Many of the more than 900 plaintiffs whose claims are centralized before Judge Wolfson have cited the roughly 22 epidemiological studies conducted since 1982 in which researchers identified a strong correlation between perineal application of talc and ovarian cancer.
Not only do plaintiffs allege that J&J knew of the possible risk of talc cancer, they also allege that the company and other defendants continued to promote their products specifically for perineal application in spite of this knowledge. In fact, when J&J learned that so many women were using their Johnson’s Baby Powder for personal hygiene purposes, they presented a similar product, Shower-to-Shower, specifically designed to appeal to women for “personal freshness”. Moreover, it has also been alleged that J&J and others established the Talc Interested Party Task Force (TIPTF) to influence federal agencies against regulation of talc products. Plaintiffs in previous talc lawsuits have also presented internal J&J memos in which company executives discuss mounting research linking talc to cancer and how to prevent this research from damaging their profits.
If the defendants’ request to limit discovery to strictly scientific and medical causation is granted, none of the above evidence will be usable by plaintiffs. In previous jury trials that ended in multi-million dollar awards to plaintiffs in talc claims, jurors said they were particularly compelled to rule for plaintiffs after hearing evidence of J&J’s alleged duplicity and negligence. According to the foreman of the jury that awarded $72 million to the family of the late Jackie Fox in a talc lawsuit last February, “It was really clear [J&J] were hiding something. All they had to do was put a warning label” on talc products to notify of potential cancer risks.
In addition to requesting limited, staged discovery for the talcum powder MDL, J&J has also reflected a desire to expedite the scheduling of bellwether trials in this matter. Bellwether trials are essentially “test” trials where attorneys can learn from jury responses to evidence and testimony to be used in subsequent claims. Verdicts in bellwether trials often lead to mass-settlements. J&J has stated that they desire 10 bellwether cases to be selected by March 1, but plaintiffs have argued that this is far too soon and even premature, since discovery had not even begun.
In addition to the talcum powder lawsuits centralized in New Jersey, there are also thousands of additional lawsuits pending in various state courts. In each of these claims, plaintiffs have either been diagnosed with cancer after using talcum powder or suffered the death of a loved one to what they believe is cancer caused by genital application of talc.
