Grieving Husband Files Talcum Powder Cancer Wrongful Death Lawsuit

Last week, an Illinois man filed a wrongful death lawsuit against Johnson & Johnson based on claims that his wife died from uterine cancer caused by genital use of their products, including Johnson’s Baby Powder and Shower-to-Shower.
Tod Alan Musgrove filed his talcum powder lawsuit in the U.S. District Court for the Northern District of Illinois on June 29, naming himself and his late wife as plaintiffs. Pamela Musgrove died from uterine cancer in June 2014, and her husband claims that she used Johnson & Johnson talcum powder products for genital hygiene for most of her life before she was diagnosed with the cancer in 2012. Mr. Musgrove claims that J&J is liable for her death due their failure to warn of the known risk of cancer associated with genital use of their talcum powder products.
While the number of talcum powder cancer lawsuits against J&J and other manufacturers of talc products has grown rapidly in recent months following a highly publicized series of multi-million verdicts awarded to plaintiffs, the vast majority of these lawsuits are based on claims that use of talcum powder caused ovarian cancer. Though Mrs. Musgrove died from uterine cancer, her husband claims that the mechanism of action believed to cause talcum powder ovarian cancer is the same.
In all recent talcum powder cancer lawsuits against J&J, plaintiffs claim that the company knew for many decades that genital application of talcum powder may greatly increase a woman’s risk of developing gynecologic cancer. In fact, more than 20 epidemiological studies from as early as 1971 have identified talcum powder in an overwhelming majority of ovarian cancer tumors and suggested that perineal application of talc may substantially increase the likelihood of an ovarian cancer diagnosis. With so much scientific evidence suggesting a link between talc and cancer, plaintiffs believe it is impossible that J&J was unaware of this risk. In fact, there is evidence in the form of internal company memos which shows that J&J not only knew of the potential risk of talcum powder cancer but that they took steps to hide this risk from consumers rather than jeopardize their own profits by adjusting product warning labels.
Mr. Musgrove claims that studies have specifically linked talcum powder to endometrial (uterine) cancer, including a 2010 study which “analyzed data from a 1976 cohort study of over 66,000 women, and found a statistically significant 21% increased risk of endometrial (uterine) cancer in postmenopausal women who had ever applied talcum powder in the perineal area. This risk rose to 24% for postmenopausal women who applied talc in the perineal area “regularly,” defined as at least once a week.”
According to Mr. Musgrove’s lawsuit, J&J even received an explicit warning about the possible link between their talcum powder and ovarian cancer in November 1994 from the Cancer Prevention Coalition in which studies dating back to the 1960s were cited. He says that a letter sent by the Cancer Prevention Coalition to J&J CEO Ralph Larson “cited a recent study by Dr. Bernard Harlow from Harvard Medical School confirming this fact and quoted a portion of the study where Dr. Harlow and his colleagues discouraged the use of talc in the female genital area. The letter further stated that 14,000 women per year die from ovarian cancer and that this type of cancer is very difficult to detect and has a low survival rate. The letter concluded by requesting that Johnson & Johnson withdraw talc products from the market because of the alternative of cornstarch powders, or at a minimum, place warning information on its talc-based body powders about [the] ovarian cancer risk they pose.”
Mr. Musgrove also states that other industries were also informed of the potential link between talcum powder and gynecologic cancer and that they took action to remove this risk by using cornstarch instead of talcum powder. One such industry, he says, is the condom industry, which stopped using talc two years after this letter was issued by the Cancer Prevention Coalition.
While Mr. Musgrove’s lawsuit is unique in that he claims that talcum powder caused uterine cancer rather than ovarian cancer, he joins a rapidly growing number of plaintiffs who seek to hold Johnson & Johnson accountable for what they deem a failure to warn consumers motivated solely by corporate greed.
