Families of Six Women file Talcum Powder Wrongful Death Lawsuit in California

Last week, the families of six women who died of ovarian cancer after using Johnson & Johnson talcum powder products for personal hygiene joined together to file a wrongful death lawsuit against the pharmaceutical giant. Four women who are still living with talcum powder ovarian cancer are also plaintiffs in this lawsuit.
On June 1, Lyn Killian Roseman, Valerie Lombardi, Linda Wong-Farenbaugh, and Malea Daughton filed as joint plaintiffs in a talcum powder ovarian cancer lawsuit against Johnson & Johnson in the California Superior Court in Santa Clara County. They were joined as plaintiffs by the families of six women who have already died from ovarian cancer allegedly caused by Johnson & Johnson talc products, Queen Esther Holcomb, Evelyn Hunt, Nancy Gustavson, Carol Pfeiffer, Carolyn T. Johnson, and Lorene G. Hepworth.
According to this lawsuit, each of the plaintiffs used a Johnson & Johnson talcum powder product such as Johnson’s Baby Powder or Shower to Shower in the vaginal area for personal hygiene, an application for which these products were specifically marketed. They claim that Johnson & Johnson had known of the association between genital use of talcum powder and ovarian cancer for some time but failed to provide warning of this potentially fatal risk to consumers, and that they also continued to market their products for this use which they knew to be unsafe. They also claim that J&J intentionally misled both the government and the public about the link between their talc products and ovarian cancer.
Their lawsuit, one of a growing number of talcum powder cancer lawsuits filed against J&J in recent months, states, “The Defendants failed to inform its customers and end users of the products of a known catastrophic health hazard associated with the use of its products. In addition, the Defendants procured and disseminated false, misleading, and biased information regarding the safety of the products to the public and used influence over governmental and regulatory bodies regarding talc.”
So far in 2016, two massive settlements have been awarded in talcum powder cancer lawsuits brought against Johnson & Johnson. The family of Jacqueline Fox, who died of ovarian cancer after a lifetime of using J&J products for personal hygiene, was awarded $72 million in February, and another woman, Gloria Ritesund, was awarded $55 million in May after a jury decided that J&J was negligent in failing to warn of talcum powder ovarian cancer risks. These lawsuits and others have drawn significant attention to the decades-long campaign by J&J to hide the known risk of talcum powder cancer and have emboldened additional women and families to come forward in demand of justice and accountability.
In the Fox and Ritesund talcum powder lawsuits, attorneys presented juries with evidence that Johnson & Johnson knew as far back as the 1970s that talcum powder was associated with a substantially higher risk of ovarian cancer. They also presented evidence of the attempts by J&J and other talcum powder manufacturers to distort scientific reports submitted to the government to diminish the apparent risk of talcum powder cancer—a risk of which J&J continues to provide no warning. In addition to failing to warn of known talcum powder cancer risks, plaintiffs claim, J&J also specifically marketed their talc products to women for genital hygiene use.
If the more than 1,200 talcum powder lawsuits J&J is currently facing proceed in the same direction as the two claims which have gone to trial so far this year, it is likely that the company will face tremendous losses which may only encourage even more women to file suit.
