Arguments against formation of Talcum Powder Lawsuit MDL

Last month, a plaintiff in a pending talcum powder ovarian cancer lawsuit filed against Johnson & Johnson filed a motion with the U.S. Judicial Panel for Multidistrict Litigation (JPML) to have all related talc lawsuits filed in federal courts centralized before a single judge for pretrial proceedings as a multidistrict litigation (MDL). Now, arguments from both plaintiffs and defendants in related talcum powder lawsuits which may be consolidated into the proposed MDL have voiced arguments in opposition to this centralization.
Tanashiska Lumas filed a talcum powder ovarian cancer lawsuit on July 1, naming Johnson & Johnson and related companies in defendants in her claim that use of their talc products caused her to develop ovarian cancer. Later in July, reports Reuters, she submitted a motion with the JPML to form a talcum powder ovarian cancer lawsuit MDL in the Southern District of Illinois.
When multiple plaintiffs file lawsuits against a common defendant based on similar questions of fact, they may be centralized as an MDL before a single judge for pretrial proceedings. This is designed to reduce duplicative discovery, prevent conflicting rulings from separate judges, and to serve the convenience of all parties involved. Once pretrial proceedings are completed, any unsettled claims in an MDL will be remanded back to the state courts where they were first filed. However, it is not uncommon for settlements to be achieved in multiple or all claims in an MDL at one time.
While it may be assumed by some that the formation of an MDL may only benefit plaintiffs, a number of plaintiffs involved in current independent or class action talcum powder lawsuits have submitted arguments against the formation of an MDL in this case.
One plaintiff, Mahnaz Khorrami, who filed a talcum powder cancer lawsuit in California, has issued a response in opposition claiming that it is too late for an MDL to make sense since multiple claims have already been settled and others have already completed much necessary discovery. This plaintiff states, “The efficiencies generated by MDL treatment relate primarily to pretrial proceedings and discovery. However, those benefits are inconsequential here because the litigation as a whole has already proceeded efficiently in courts across the country without MDL treatment. This coordination can continue with any newly filed cases through various procedural tools available to the parties, without the need for centralization.”
Other plaintiffs, Mona Estrada and Barbara Mihalich, have also stated opposition to the proposed MDL, claiming that their cases have proceeded too far for the MDL process to benefit them. These plaintiffs also claim that many of the talcum powder lawsuits pending in federal courts at this time are based on different causes of action, including wrongful death, personal injury, and consumer protection claims.
In addition to these arguments against the MDL, some plaintiffs who support the MDL believe that it should be held in a different court than the one suggested by Lumas.
For their part, the main defendant in most of the pending lawsuits, Johnson & Johnson, agrees that consolidation may be appropriate for these cases but has requested that the MDL be formed near their company headquarters in New Jersey or in Oklahoma.
When Lumas filed the motion to consolidate these claims with the JPML, she stated that the MDL would include 11 currently pending cases and would likely grow substantially as more cases are filed. There has been a marked growth in filings of talcum powder cancer lawsuits in recent months, partially due to extensive media coverage of two multi-million verdicts awarded to plaintiffs earlier this year.
