Alabama Woman Joins Talcum Powder MDL

For generations, women across the globe have adopted the habits of their mothers and even their grandmothers by using talcum powder for feminine hygiene purposes, never knowing that research had linked perineal application of talc to ovarian cancer since at least 1971. Now that the potential link between talc and gynecologic cancers is gaining notoriety after multiple plaintiffs have received multi-million dollar awards in talcum powder cancer lawsuits, a growing number of women and their loved ones are also pursuing compensation from talc product manufacturers.
In October, a panel of federal judges ruled that enough talcum powder lawsuits had been filed against common defendants (most notably Johnson & Johnson) and based on common claims that they should be centralized before a single judge for coordinated pretrial proceedings. Thus, the multidistrict litigation (MDL) combining more than three-dozen talc cancer lawsuits before U.S. District Judge Freda L. Wolfson in the U.S. District Court for the District of New Jersey was formed. Since then, any new talcum powder cancer lawsuits filed in district courts will be moved to the MDL in New Jersey.
One of the most recent plaintiffs to join the talcum powder cancer MDL is an Alabama woman named Annie Williams, who filed her talc lawsuit on November 29. Like other plaintiffs, Williams seeks to hold Johnson & Johnson and their talc supplier, Imerys Talc America, accountable for her diagnosis with ovarian cancer due to their failure to warn of this risk. She also names the Personal Care Products Council as a defendant, as well as other industry groups.
According to her lawsuit, Annie Williams used J&J Baby Powder and Shower-to-Shower products for roughly 22 years. She says that during these years, Johnson & Johnson advertised both products as safe and hygienic and encouraged women to apply them to their perineal area. She states:
Historically, “Johnson’s Baby Powder” has been a symbol of freshness, cleanliness, and purity. During the time in question, the Johnson & Johnson Defendants advertised and marketed this product as the beacon of “freshness” and “comfort”, eliminating friction on the skin, absorbing “excess wetness” helping keep skin feeling dry and comfortable, and “clinically proven gentle and mild.” The Johnson & Johnson
Defendants instructed women through advertisements to dust themselves with this product to mask odors. The bottle of “Johnson’s Baby Powder” specifically targets women by stating, “For you, use every day to help feel soft, fresh, and comfortable.”
During the time in question, the Johnson & Johnson Defendants advertised and marketed the product “Shower to Shower” as safe for use by women as evidenced in its slogan “A sprinkle a day keeps odor away”, and through advertisements such as “Your body perspires in more places than just under your arms. Use SHOWER to SHOWER to feel dry, fresh, and comfortable throughout the day,” and “SHOWER to SHOWER can be used all over your body.”
Despite J&J’s promotion of their talcum powder products as safe and especially designed for female genital application, Williams states in her claim that studies dating as far back as 1971 have suggested that genital application of talc may increase the risk of ovarian cancer. In fact, she says, there have been roughly 22 epidemiological studies to draw a correlation between talc and ovarian cancer since 1982. According to Williams, when the United States National Toxicology Program deemed talc to be a carcinogen in 1993, J&J and other members of the Cosmetic Toiletry and Fragrance Association (CTFA) formed a special task force to supply this agency with biased research supporting the safety of talc—allegedly lying to the government to protect their own profits.
Like other plaintiffs in talcum powder lawsuits, Williams also cites a letter mailed to the CEO of J&J by the Cancer Prevention Coalition in 1994 specifically and clearly warning of the link between talc and cancer and encouraging the company to replace the talc in their products with cornstarch.
Despite so much evidence that J&J was aware of the alleged risk of talcum powder cancer, however, Williams argues that the company never issued a warning to consumers about this risk. Had she known that the body powders she used every day may increase her risk of cancer, Williams says she would have stopped using them immediately. Thus, she claims, her development of ovarian cancer “was the direct and proximate result of the unreasonably dangerous and defective condition of the [talc] products at the time of sale and consumption, including their lack of warnings…”
As a result of their alleged negligence leading to her diagnosis with ovarian cancer, physical and emotional pain and suffering, medical expenses, and other damages, Annie Williams has requested a jury trial and compensation in excess of $75,000.
As progress picks up with the talcum powder MDL in New Jersey, a separate group of talcum powder lawsuits are proceeding in St. Louis, Missouri.
