94-Year-Old Plaintiff Used Talcum Powder Even After Ovarian Cancer Diagnosis

In a recent talcum powder lawsuit, a 94-year-old woman says she continued to use talcum powder for feminine hygiene purposes even after she was diagnosed with ovarian cancer and underwent extreme treatment.
According to the talc cancer lawsuit filed by Frances Escobedo on February 6 in the U.S. District Court for the Southern District of California, this woman used talcum powder products made by Johnson & Johnson on her genital area nearly every day over the course of more than 90 years. In fact, since J&J failed to disclose the possible risk of ovarian cancer associated with products like Johnson’s Baby Powder and Shower-to-Shower, Escobedo says she continued to use these products even after she was diagnosed with ovarian cancer in 2013.
Frances Escobedo is not alone in her allegation that J&J and other companies like Imerys Talc America had reason to alert consumers to the possible risk of ovarian cancer resulting from perineal application of cosmetic talc products. Currently, there are more than 2,000 talcum powder cancer lawsuits pending in a Missouri state court, as well as dozens of federal talc lawsuits centralized as a multidistrict litigation (MDL) before U.S. District Judge Freda L. Wolfson in the U.S. District Court for the District of New Jersey.
In these lawsuits, plaintiffs allege that J&J and other defendants should have been aware as early as 1971 of scientific research suggesting a substantial increase in the likelihood of ovarian cancer when talcum powder is applied to the genital region. However, rather than adhere to their duty to warn consumers of even the possibility of a risk so severe, there is evidence that J&J and others actually took steps to hide this risk from the public. Furthermore, decades after the first studies linking talc and ovarian cancer were published, J&J continued to promote their products specifically for women’s “personal freshness” through perineal application. Even now, as many plaintiffs cite more than 22 epidemiological studies linking talc and cancer since the 1980s, J&J steadfastly denies the carcinogenicity of their products. On the company website page called “Important Facts about the Safety of Talc,” J&J refers to two studies that “found no association between talc and ovarian cancer”, and company representatives have said that they stand behind this science.
What may differentiate Frances Escobedo’s lawsuit from the rapidly growing number of talcum powder lawsuits is the sheer duration of her use of talc products for personal hygiene. According to her complaint, “When Plaintiff was an infant, her mother applied Shower to Shower, and J&J Baby Powder to Plaintiff. As she grew up, and throughout her life, Plaintiff continued to use the Products daily. Plaintiff continued to use the Products following her initial diagnosis of ovarian cancer in 2013. There was never any indication, on the Products, packaging or otherwise, that this normal use could and would cause Plaintiff to have developed or to develop ovarian cancer.”
According to Escobedo, it should be obvious that she would not have continued to use a product that may have been responsible for her development of ovarian cancer after she was diagnosed with this very aggressive disease. Even as recently as 2013, though, she had no cause to know that applying talc products to her genital area may cause or contribute to her suffering. Since her diagnosis, she has undergone a multitude of surgical procedures and other harsh treatments, including chemotherapy, radiation, Type 2 radical oophorectomy with retrograde total abdominal hysterectomy, bilateral salpingo-oophorectomy, partial rectosigmoidectomy with staple side-to-end low rectal anastomosis, and bilateral ureterolysis surgery.
As a result of J&J’s negligent and intentional failure to warn of potential talcum powder ovarian cancer risks, Escobedo says she has endured physical and mental pain and suffering, fear of death, medical expenses, and other damages. She also seeks punitive damages, in light of what she terms the defendants’ acting “willfully, wantonly, with an evil motive, and recklessly.” Her lawsuit will be centralized with other talcum powder lawsuits in New Jersey for coordinated pretrial proceedings.
