$55M to Plaintiff in Johnson & Johnson Talcum Powder Lawsuit
May 4th, 2016
Yesterday, Johnson & Johnson lost its second talcum powder cancer lawsuit. A St. Louis jury found that the company had failed to provide adequate warning of the risk of ovarian cancer associated with use of their talcum powder products and awarded a woman $55 million in compensatory and punitive damages.
CNN Money reports that, according to her talcum powder lawsuit, Gloria Ritesund had used J&J talcum powder for personal hygiene for more than 35 years, and that she claims this led to her diagnosis with ovarian cancer in 2011. Ritseund and her attorneys argued that the company had known for decades that genital use of talc products was associated with an increased risk of ovarian cancer, but that they willfully withheld warnings about this risk from the public.
According to a statement from Ritesund’s lawyers, “Internal documents from J&J show it knew of studies connecting talc use and ovarian cancer but, to this day, it continues to market it as safe—neglecting any warning.”
In a similar statement, J&J spokesperson Carol Goodrich says, “Multiple scientific and regulatory reviews have determined that talc is safe for use in cosmetic products and the labeling on Johnson’s Baby Powder is appropriate.”
However, despite assertions from the company that their baby powder and other talc products are safe, this is the second talcum powder cancer lawsuit they have lost just this year and they may be facing up to 50 additional related lawsuits.
Talc products are classified as cosmetics, so they do not go through the same rigorous testing required for other products to gain FDA approval. Nevertheless, the manufacturers of cosmetic products must label them properly and these products “must be safe for use by consumers under labeled or customary conditions of use,” states the FDA.
In talcum powder cancer lawsuits, some plaintiffs have claimed that Johnson & Johnsons and other companies specifically marketed their talcum powder products for use for feminine hygiene purposes. However, studies dating as far back as the 1970s have suggested that it is possible for talc to make its way to the ovaries, and that talc has been found in a shocking number of ovarian cancer tumors. Thus, it has been claimed, J&J did not ensure its products were safe under FDA regulations, especially since they continued to market their products specifically for female genital use.
In February, a St. Louis jury awarded $72 million to the family of Jackie Fox, a woman who died from ovarian cancer they claimed was caused by a lifetime of using J&J talc products. In this most recent lawsuit, the jury deliberated for three days before finding in favor of Ritesund. The jury awarded her $5 million in compensation for her damages, and a massive $50 million in punitive damages designed to punish J&J for their negligence in failing to warn of known or suspected talcum powder cancer risks.
Even as Johnson & Johnson states that they will appeal this verdict, women and their families continue to file ovarian cancer lawsuits against the company. If you or a woman you love has been diagnosed with ovarian cancer after using talcum powder or baby powder products, you may be owed substantial compensation.
